PUBLIC PARTICIPATION:
Although the City Council values your comments, the Brown Act generally prohibits the
Council from taking action on any matter not listed on the posted agenda as a business
item. Out of an abundance of caution and due to the extraordinary nature of a pandemic,
the City of Hermosa Beach is taking additional precautions to reduce the possibility of
community transmission of the Novel Coronavirus (COVID-19). The City is encouraging
the submission of e-comments or email comment in place of in-person public comment.
Anyone wishing to make public comment in person, may do so from a microphone in the
Council Chambers lobby area in order to observe social distancing guidelines.
Comments from the public are limited to three minutes per speaker.

CITY COUNCIL DECLARATION OF AN EMERGENCY
WITH ATTENDANT ORDERS
Recommendation:Staff recommends that the City Council adopt the attached resolution (to be added as a
supplemental item on Monday, March 16, 2020) ratifying the Proclamation of the
existence of a local emergency by the Mayor and further declaring as follows:
a. All restaurants, alcohol beverage establishments and snack shops in the City are
hereby ordered closed to onsite patronage until March 28, 2020.
i. Take-out orders and delivery of meals are permitted, provided that take-out orders are
picked up by a single person and the establishments maintain social distance in any
necessary queuing of patrons.
[ALTERNATIVELY: All restaurants, alcohol beverage establishments and snack shops
in the City are hereby ordered to reduce occupancies and remove or rearrange furniture
as necessary to implement social distancing standards]
b. Commercial landlords in the City are hereby prohibited from (i) charging rent or (ii)
evicting commercial tenants for nonpayment of rent with respect to tenants whose
businesses are subject to this Order or are otherwise closed (voluntarily or by mandate)
to prevent or reduce the spread of COVID-19. A landlord knows of a tenant's closure
within the meaning of this Order if the tenant, within 30 days after the date rent is due,
notifies the landlord in writing of such closure, and provides appropriate documentation to
support the claim. For purposes of this Order, "in writing" includes email or text
communications to a landlord or the landlord's representative with whom the tenant has
previously corresponded by email or text. Any financial information provided to the
landlord shall be held in confidence, and only used for evaluating the tenant's claim.
c. All formal and informal organized and group activities, games and sports, with the
exception of family outings, are hereby prohibited in all City parks and the beach.
d. The City shall post signs at all City parks advising that:
i. COVID-19 is known to survive on various surfaces such as children's play equipment,
bathroom surfaces, tables, benches, railings, and other fixtures, for 72 or more hours;
ii. Park users shall maintain social distance as prescribed by the Beach Cities Health
District; and
iii. Park users with symptoms consistent with COVID-19 infection are encouraged to
isolate themselves at home and contact their health care provider or, if they do not have a
health care provider, the City of Hermosa Beach Police Department to receive prompt
diagnosis and care.
e. Any other orders determined necessary by the City Council based on circumstances
as they exist at the time of the special meeting.

Discussion:
The City has an emergency plan,including an emergency services organization that is activated in
the event of emergency to coordinate functions of the City with all other public agencies,
organizations and those people affected by the disaster.Title 2,Chapter 2.56 of the Hermosa Beach
Municipal Code empowers the Mayor to proclaim the existence of a local emergency when the City is
affected by a public calamity and the City Council is not in session.The Director of Emergency
Service’s declaration is subject to City Council ratification within seven days.
An emergency exists when conditions are beyond the control of the services,personnel,equipment,
facilities,and existing laws of this City.The declaration is an acknowledgement of the need for the
combined forces of other political subdivisions to combat.
A severe acute respiratory illness caused by a novel (new)coronavirus,known as COVID-19,has
spread globally and rapidly,resulting in severe illness and death around the world.The World Health
Organization has described COVID-19 as a global pandemic.
On March 4,2020,California Governor Gavin Newsom declared a State of Emergency in response
to the increased spread of COVID-19.Additionally,on March 4,2020,the Los Angeles County Board
of Supervisors and the Los Angeles County Department of Public Health all declared a local and
public health emergency in response to increased spread of COVID-19 across the country and in Los
Angeles County.The President of the United States has declared a federal emergency as a result of
the spread of the COVID-19.
On March 11, 2020, Los Angeles County announced the first death related to COVID-19.
On March 12,2020,California Governor Gavin Newsom ordered cancellation of all gatherings of over
250 people anywhere in the State and further called for canceling or postponing smaller gatherings
where those attending cannot keep six feet apart from each other and limiting gatherings of older or

relatively unhealthy people more vulnerable to COVID-19 to no more than 10 people.
The City activated its Emergency Operations Center on March 16,2020 and the City has cancelled
or postponed all non-essential City-hosted and permittted programs and events to help prevent
further spread of COVID-19 and protect vulnerable populations,such as seniors and people with
compromised immune systems, from infection.
Due to the increase of reported cases associated with COVID-19,there is an imminent and
proximate threat of introduction of COVID-19 in the City,or the undetected presence of COVID-19
infections in the City,that threatens the safety,health,and welfare of City residents,businesses,and
visitors and warrants a declaration of local emergency.
Before the City Council today is a resolution ratifying the Mayor’s declaration and proclaiming a state
of local emergency.If adopted,the City Council will review,and as needed renew,this action at least
every 60 days.The declaration will enable City staff to take actions to respond to the conditions
created by COVID-19 and will assist residents and the City in obtaining aid and other assistance.
Fiscal Impact:
There is a potentially positive fiscal impact associated with the recommended action because the
existence of the local emergency will help qualify the City for reimbursement of certain expenditures
associated with disaster response.

RESOLUTION NO. 20-7230
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA
BEACH CONFIRMING THE EXISTENCE OF A LOCAL EMERGENCY
The City Council of the City of Hermosa Beach does hereby find, order and resolve as follows:
SECTION 1. Recitals.
A. Title 2, Chapter 2.56 of the Hermosa Beach Municipal Code empowers the
Mayor to proclaim the existence or threatened existence of a local emergency when the City is
affected or likely to be affected by a public calamity and the City Council is not in session,
subject to ratification by the City Council within seven days.
B. A severe acute respiratory illness caused by a novel (new) coronavirus, known
as COVID-19, has spread globally and rapidly, resulting in severe illness and death around the
world. The World Health Organization has described COVID-19 as a global pandemic.
C. On March 4, 2020, California Governor Gavin Newsom declared a State of
Emergency in response to the increased spread of COVID-19. Additionally, on March 4, 2020,
the Los Angeles County Board of Supervisors and the Los Angeles County Department of
Public Health all declared a local and public health emergency in response to increased spread
of COVID-19 across the country and in Los Angeles County. The President of the United
States has declared a federal emergency as a result of the spread of the COVID-19.

H. The Director of Emergency Services now requests the City Council ratify the
Mayor's proclamation of the existence of a local emergency issued on March 16, 2020 in
accordance with Hermosa Beach Municipal Code Section 2.56.090.
SECTION 2. The Proclamation of Existence of a Local Emergency by the Mayor is hereby
ratified.
SECTION 3. It is hereby proclaimed that a local emergency now exists throughout the City. It
is further proclaimed and ordered that during the existence of this local emergency the powers,
functions, and duties of the Director of Emergency Services and the emergency organization of
this City shall be those prescribed by State law and by the ordinances and resolutions of this
City.
SECTION 4. The local emergency shall be deemed to continue and exist until its termination
is proclaimed by the City Council. As required by law, the City Council shall review the need
to continue the state of emergency every 60 days until this resolution is terminated.
SECTION 5. Pursuant to the authority prescribed by Hermosa Beach Municipal Code Section
2.56.090, the City Council hereby orders as follows (the “Order”), to take effect immediately
and remain in effect until March 28, 2020, unless extended by the City Council or City
Manager:
A. All restaurants, alcohol beverage establishments and snack shops in the City are hereby
ordered closed to onsite patronage; provided, however, that take-out orders and delivery
of meals are permitted provided that take-out orders are picked up by a single person
and the establishment maintains social distance in any necessary queuing of patrons.
B. All formal and informal organized and group activities, games and sports, with the
exception of family outings, are hereby prohibited in all City parks and the beach;
C. The City shall prohibit access to play structures at all City parks;
D. The City shall post signs at all City parks advising that:
I. COVID-19 is known to survive on various surfaces such as children’s play
equipment, bathroom surfaces, tables, benches, railings, and other fixtures, for 72 or
more hours; and
II. Park users shall maintain social distance as prescribed by Beach Cities Health

writing of the lost income and inability to pay rent due to a limitation or closure of the
tenant’s business related to COVID-19, with appropriate supporting documentation. If
a tenant suffers only a partial loss of income, the tenant shall pay the pro-rated share of
their rent that corresponds to the income they generated during the period of loss. For
purposes of this Order, “in writing” includes email or text communications to a landlord
or the landlord’s representative with whom the tenant has previously corresponded by
email or text. All financial information provided to the landlord shall be kept in
confidence and only used for evaluating the tenant’s claim or enforcing this provision.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA
BEACH CONFIRMING THE EXISTENCE OF A LOCAL EMERGENCY
The City Council of the City of Hermosa Beach does hereby find, order and resolve as follows:
SECTION 1. Recitals.
A. Title 2, Chapter 2.56 of the Hermosa Beach Municipal Code empowers the
Mayor to proclaim the existence or threatened existence of a local emergency when the City is
affected or likely to be affected by a public calamity and the City Council is not in session,
subject to ratification by the City Council within seven days.
B. A severe acute respiratory illness caused by a novel (new) coronavirus, known
as COVID-19, has spread globally and rapidly, resulting in severe illness and death around the
world. The World Health Organization has described COVID-19 as a global pandemic.
C. On March 4, 2020, California Governor Gavin Newsom declared a State of
Emergency in response to the increased spread of COVID-19. Additionally, on March 4, 2020,
the Los Angeles County Board of Supervisors and the Los Angeles County Department of
Public Health all declared a local and public health emergency in response to increased spread
of COVID-19 across the country and in Los Angeles County. The President of the United
States has declared a federal emergency as a result of the spread of the COVID-19.
D. On March 11, 2020, Los Angeles County announced the first death related to
COVID-19.
E. On March 12, 2020, California Governor Gavin Newsom ordered cancellation
of all non-essential gatherings over 250 people anywhere in the State and further called for
canceling or postponing even smaller gatherings where those attending cannot keep six feet
apart from each other and limiting gatherings of older or relatively unhealthy people more
vulnerable to the disease to no more than 10 people.
F. The City activated its Emergency Operations Center on March 16, 2020 and the
City has cancelled or postponed all non-essential City-hosted and permitted programs and
events to help prevent further spread of COVID-19 and protect its vulnerable populations, such
as seniors and people with compromised immune systems, from infection.
G. Due to the increase of reported cases associated with COVID-19, there is an
imminent and proximate threat of introduction of COVID-19 in the City that threatens the
safety and health of City residents and warrants a declaration of local emergency.

H. The Director of Emergency Services now requests the City Council ratify the
Mayor's proclamation of the existence of a local emergency issued on March 16, 2020 in
accordance with Hermosa Beach Municipal Code Section 2.56.090.
SECTION 2. The Proclamation of Existence of a Local Emergency by the Mayor is hereby
ratified.
SECTION 3. It is hereby proclaimed that a local emergency now exists throughout the City. It
is further proclaimed and ordered that during the existence of this local emergency the powers,
functions, and duties of the Director of Emergency Services and the emergency organization of
this City shall be those prescribed by State law and by the ordinances and resolutions of this
City.
SECTION 4. The local emergency shall be deemed to continue and exist until its termination
is proclaimed by the City Council. As required by law, the City Council shall review the need
to continue the state of emergency every 60 days until this resolution is terminated.
SECTION 5. Pursuant to the authority prescribed by Hermosa Beach Municipal Code Section
2.56.090, the City Council hereby orders as follows (the “Order”), to take effect immediately
and remain in effect until March 28, 2020, unless extended by the City Council or City
Manager:
A. All restaurants, alcohol beverage establishments and snack shops in the City are hereby
ordered closed to onsite patronage; provided, however, that take-out orders and delivery
of meals are permitted provided that take-out orders are picked up by a single person
and the establishment maintains social distance in any necessary queuing of patrons.
B. All formal and informal organized and group activities, games and sports, with the
exception of family outings, are hereby prohibited in all City parks and the beach;
C. The City shall prohibit access to play structures at all City parks;
D. The City shall post signs at all City parks advising that:
I. COVID-19 is known to survive on various surfaces such as children’s play
equipment, bathroom surfaces, tables, benches, railings, and other fixtures, for 72 or
more hours; and
II. Park users shall maintain social distance as prescribed by Beach Cities Health
District, as provided in Exhibit 1 attached hereto;
III. Park users with symptoms consistent with COVID-19 infection are encouraged to
isolate themselves at home and contact their health care provider or, if they do not
have a health care provider, the Los Angeles County Department of Health to assist
with receiving prompt diagnosis and care.

WHEREAS, the California Emergency Services Act, Government Code section
8550, et seq., authorize the proclamation of a local emergency when conditions of
disaster or extreme peril to the safety of persons and property within the territorial limits
of a city exist; and
WHEREAS, Hermosa Beach Municipal Code section 2.56.050.A empowers the
Mayor, the Mayor Pro Tem, or the City Manager, acting as the Director of Emergency
Services, if neither the Mayor nor the Mayor Pro Tem are available, to proclaim the
existence or threatened existence of a local emergency when the City is exposed to an
actual or threatened existence of conditions of disaster or of extreme peril to the safety
of persons and property within the City and the City Council is not in session; and
WHEREAS, the Mayor of the City of Hermosa Beach does hereby find as
follows:
That there exists a global spread of a severe acute respiratory illness caused by
a novel (new) coronavirus (“COVID-19”), an infectious virus that has resulted in the
illness and death of several California residents, which the World Health Organization
has described COVID-19 as a pandemic;
That the State of California and counties throughout California are reporting
exposure of residents to COVID-19 and expect that the number of residents becoming
ill from COVID-19 will increase;
That, due to the increase of reported cases associated with COVID-19, there is
an imminent and proximate threat of introduction of COVID-19 in the City that threatens
the safety and health of City residents and warrants a declaration of local emergency;
That a declaration of a local emergency will assist in a coordinated public health
response to reduce transmission and illness severity, provide assistance to health care
providers, coordinate and mitigate public services that may be disrupted from this
emergency, and mitigate any other effects of this emergency on the citizens of the City;
That on March 4, 2020, California Governor Gavin Newsom declared a State of
Emergency in response to the increased spread of COVID-19. Additionally, on March 4,

2020, the Los Angeles County Board of Supervisors and the Department of Public
Health all declared a local and public health emergency in response to increased
spread of COVID-19 across the country and in Los Angeles County;
That the President of the United States has declared a federal emergency as a
result of the spread of the COVID-19;

the disease to no more than 10;
That it is anticipated that more restrictive protocols will be put in place;
That conditions of extreme peril or potential peril to the safety of persons and
property exist, and the condition is beyond the capability of the local forces to control
effectively; and
That the City Council of the City of Hermosa Beach is not in session (and cannot
immediately be called into session).
NOW, THEREFORE, IT IS HEREBY PROCLAIMED that conditions of extreme
peril to the safety of persons and property have arisen within the City caused by a public
health emergency related to the COVID-19 virus; and
BE IT FURTHER PROCLAIMED that a local emergency now exists throughout
the City of Hermosa Beach as a result of the COVID-19 virus, and
BE IT FURTHER PROCLAIMED that this proclamation shall be in effect for a
period of seven days by which time it must be ratified by the City Council pursuant to
Government Code section 8630;
AND HEREBY ORDERED during the existence of said local emergency that the
powers, functions, and duties of the emergency organization of this City shall be those
prescribed by state law, by ordinances, and resolutions of this City, and by the City of
Hermosa Beach Emergency Operations Plan; and

BE IT FURTHER ORDERED that all City officers and employees take all steps
requested by the Director of Emergency Services to prevent the spread of COVID-19
and to prevent or alleviate illness or death due to the virus; and
BE IT FURTHER ORDERED It is hereby proclaimed and ordered that a copy of
this proclamation be forwarded to the Los Angeles County Office of Emergency
Management to be forwarded to the Director of California Governor's Office of
Emergency Services requesting that the Director find it acceptable in accordance with
State law; that the Governor of California, pursuant to the Emergency Services Act,
issue a proclamation declaring an emergency in the City of Hermosa Beach under Los
Angeles County; that the Governor waive regulations that may hinder response and
recovery efforts; that response and recovery assistance be made available under the
California Disaster Assistance Act; and that the State expedite access to State and
Federal resources and any other appropriate Federal disaster relief programs.

eComment: This is obviously a rubber stamp meeting and this is going to pass... What is the
formal process to extend this past March 28? The city should be proactive and schedule a follow
up meeting on March 26 to discuss extending this Proclamation in full rather than go back to
normal on a Saturday/Sunday and then have this discussion again on Monday March 31st. If not
in full, it should extended under modified circumstances and that expectation should be set now.
Based on the circumstances of what we are dealing with it makes absolutely no sense to close
businesses for 12 days and then just go back to business as usual and potentially suffer a
setback. At a minimum, I implore the city to ban all live entertainment and any "events" (music,
DJ's etc.) until Friday May 1st. Hermosa Beach as a destination for outside tourists needs to be
limited. The city council's first and foremost responsibility is the health and safety of it's residents;
the city should operate as such and proceed with more caution than may seem necessary at this
time.

19, I object to the City mandate that landlords are not allowed to collect rent. Landlords have
expenses which continue including debt service, taxes, insurance etc. The rent negotiations
during the crisis should be a negotiation between Tennant and the landlord without government
interference. Certain tenants may have business interruption insurance. The City cannot
constitutionally void our lease contracts under the takings clause. The landlords should be free
to work out adjusted rent or rent abatement with tenants without the city involvement. The city
opens themselves up to litigation as a result of this poorly conceived legislation.

eComment: Mayor and Council members, These are extraordinary times, for sure, and
extraordinary measures need to be taken. That being said, I would like for you to think about the
impacts of your proposal, to allow certain tenants complete rent relief during this crisis. From
what I find, Hermosa seems to be the only city mandating this. I thoroughly understand the
mandate of having to close restaurants, bars and the like, in the interest of common health.
However, what I don’t think you understand is that property owners are businesses too. This
mandate would just be alleviating the burden of one business yet passing the burden to another
business. Why is one more important than the other? As a property owner, I still need to make
my mortgage payment, pay my bills, pay my taxes, city fees, etc. This is also my way of making
a living. I am retired and the rental income I receive is what I live on, as it is to the businesses
you are relieving. Note that the federal government will be providing income relief to these
business’s employees which is a big part of their expenses. There has been no such talk of
property owner relief. Of course, I do not think all of the burden should be on the tenant. I would
like for you to consider sharing this responsibility between landlord and tenant by strongly
suggesting landlords reduce or defer rent during the mandated time in which the establishments
are closed. I understand you are trying to help the “mom and pop” businesses so they do not get
wiped out; however, there are several landlords that are mom and pops too. I would have come
before you tonight, but as you have recommended, I am home watching. Thank you for your
consideration and leadership.

eComment: While I absolutely support social distancing, working remote if possible, and staying
at home if you are sick, I would ask the Council to reconsider dramatic city policies that will will
effect the livelihood of businesses and Hermosa Beach residents. To begin, the number one way
to combat not only the coronavirus but also all viruses is have a healthy cardiovascular system.
For this reason, I would recommend gym facilities and public running trails be allowed to remain
open. For gyms, I recommend reduction in occupancy at any given time and the requirement to
have "corona virus combating wipes" which have been around for many years. We also need to
consider the mental health of our residents. While we should encourage people staying home as
much as possible, we should also encourage residents to enjoy the outdoors and keep a six feet
distance between themselves and residents outside their homes. In addition, we need to
consider the economic implications of our small beach city if we elect to shut down all "non-
essential" businesses. We should, like I recommended with gyms, allow businesses to continue
operating in whatever capacity they see fit for themselves. Restaurants should be able to remain
open at a limited occupancy with a heavy focus on take out options. We should encourage
residents to shop locally as much as possible in order to stimulate our local economy and keep
our businesses afloat during this stressful time. Finally, I highly encourage the city to be
proactive in their communication and focus on not inducing fear into the public. We are a small
but mighty town and working together through this time will allow us to come out on top in the
end.

eComment: I appreciate your bold action and support the changes/restrictions proposed specific
to restaurants and bars, social distancing and warnings. As the spread of this virus is
exponential, swift action is especially important. Those who might think that these measures are
too extreme should be reminded that many government actions of a few weeks ago seemed
extreme (if not laughable) at the time, but now seem appropriate. In many cases, they
should have been implemented even earlier. Your "reward" for decisive action will be criticism
for overreacting...so be it. A few additional thoughts: 1) If we do not act in similar fashion to other
communities, we will draw in additional customers that (for instance) patronize our restaurants if
those in neighboring cities are closed. That presents undue risk to our community. 2) I did not
see a mention of gyms and other workout facilities. I would encourage you to understand what is
being done in other cities as well as what is recommended by science-based public health
officials specific to gyms and workout facilities of all types. I believe they are being closed
mandatorily and some individual facilities have already voluntarily closed. Thank you for your

eComment: I am the owner of Pierside Properties LLC, which owns a retail building at 49-53 Pier
Avenue. Included in my building are several restaurants, which would be impacted by the
proposed rules of Report 20-0167. As a landlord of property in the City of Hermosa Beach, I
strongly disagree with the passage of the rules in the Report that affect restaurants, alcohol
beverage establishments and snack shops (and their landlords) for the following reasons: • The
State of California has already issued rules for these types of establishments which are similar to
the rules being proposed by the City regarding prohibition of on-site patronage. The city rules are
duplicative and unnecessary. • Regarding the proposed rule prohibiting the charging of rent
during the emergency, the City does not have authority to legislate the terms of business
contracts between private parties. o You are attempting to transfer business risk from restaurant
and bar operators to the property owners. This is not the role of City government. o These
business owners may have or could have purchased Business Interruption Insurance. o We
have every intention of enforcing our rights under our tenant leases. By giving the tenants the
impression that they are not legally obligated to comply with their contractual obligations, you are
putting them at risk of eviction when we enforce our rights under the leases and the courts
determine that the City does not have the right to interfere with these contracts. o Furthermore, I
will not renew leases to any tenant that refuses to pay rent following the City’s directive. o You
are putting the City at risk by assuming • Since the City is offering to prohibit Landlords from
collecting their rent, will the City be waiving all city fees and property taxes? Will the City force
lenders to waive interest on our loans? Will the councilmembers be waiving their salaries and
stipends to help these distressed businesses? • If the City is worried about the business health
of bars and restaurants, why not offer them a line of credit backed by the City? The City does not
have authority to put that burden on private businesses. • Regardless of this City rule, I will work
with my tenants in the ordinary course of business to postpone/defer part of the rent if the
circumstances warrant it. But this should be a business decision, not a City imposed obligation.
As a business owner in Hermosa Beach, I will challenge in court any city rule which states that I
cannot form a contract with my tenants and collect rent as a result of them occupying my
property. I strongly urge you to remove these provisions from Report 20-0167.

Hi Mary:
I hope you are doing well durning these uncertain times. I left you a voicemail regarding the upcoming
council meeting. I would like to attend the meeting, but given the circumstances and what is being
requested of us by the Federal Government, I don't feel we should be congregating in groups.
I wanted to write in regards to one of the topics on tonight’s agenda. Specifically the agenda regarding
tenants paying rent to landlords. We own the property where the Post Office is across the street from
City Hall. We have proactively reached out to our tenants in an effort to work with them in these
uncertain times. We recognize that most businesses are being negatively effected by this virus and the
extent of how each is being effected is still unknown. While I can understand the City is desperately
trying to help these business, you are doing so at the cost of our business. No matter what the city
decides, we still have to pay our lenders, property managers, utility companies, insurance policies etc.
We do not have the ability to stop making these payments. If all tenants can halt rent payments, we are
in serious jeopardy of default and loss of property. We should be afforded the ability to negotiate with
our tenants without government intervention to find a workable solution for all parties. Just like the
Resturant’s and bars in the city, we are a local business too. We are also being severely impacted by
these shutdowns. All of us are trying to make choices so we can survive in the future. If you pass this
item, we loose our ability to make any arrangements to try and stay in business. This will cause severe
repercussions to every land owner in the city.
When the dust settles from this outbreak, we all want to be in a position to flourish and re-emerge
stronger than before. If you vote to limit property owners rights and it leads to foreclosure and blighted
properties it will take significantly more time to bounce back. In addition, I have concerns that legally
this city will face litigation for their interference with private property rights which could cost the tax
payer a lot more money in the long run.
We are all in this together. We want what is best for the business, and residents of Hermosa Beach and
beyond. Please vote against this policy so we have the tools to rebuild when the dust settles.

rent abatement should be handled by landlords and their tenants. By leasing property to run their
businesses, tenants assume the risk brought on by crises like the novel coronavirus, and should

Subject: my two cents and a little fear
Hello all. My name is Solange Comer and I am the owner of our beloved South Bay's only cheese shop ,
CULTURED SLiCE here in Hermosa. As a small business owner, and a single mom I have huge concerns
for how the COVID-19 virus will impact my shop and future. Me, along with so many other small
business owners. While I am fortunate to still be open, I have had to cut back staff, shop hours, and
cancel product orders. And I could be told any day I need to close up for a few weeks. If that happens I
am left with massive amounts of perishable product that will be a huge loss, bills and still a large rent to
pay. Which is honestly my biggest concern. How can the city help with rent? Can you help with rent?
Between my home rent and my business rent, I am not sleeping much at night. I know I am not alone in
these fears and losses, but I also know I am not alone in wanting to work together and do everything I
can to make these next few weeks, possibly months as easy as possible.

Hi,
I was at the Pier in downtown Hermosa yesterday with my two young children. I was surprised by the
number of people out-and-about and eating at restaurants.
I strongly recommend that you follow the lead of the Mayor Garcetti and close bars and restaurants for
a few weeks. Residents are not taking coronavirus as seriously as they should be.
Just like climate change, most people don't take action until it affects them personally, which will be too
late. The government needs to step in in the interest of it's citizens, especially those most vulnerable.

I understand the necessity to take action, however I urge to carefully think about negative
consequences and weigh them before making your decision.
The supermarket shelves are empty, and for many residents food from restaurants is the only
option. Based on all the information I have, this emergency may last two months or longer. I
certainly don't have sufficient food at home for that length of time. I urge you to do everything
possible to keep restaurants operating.
I support the options of allowing restaurants to provide takeout, delivery of meals, or reduce
occupancy. Whatever it takes to keep them operating.

eComment: Honorable Mayor and City Council Members: Our company operates numerous
commercial properties in the South Bay including Hermosa Beach and I am an owner in several
including one in Hermosa Beach. I appreciate the City’s desire to locally enforce the recent
guidelines from the Governor of California and the CDC. However I believe each business owner
now needs to take actions that are appropriate to their individual business. Mandating
compliance is not a necessary response. Issuing guidelines as a request is more appropriate.
Additionally, the City attempting to prohibit Landlords from charging rent to their commercial
tenants is the most concerning. Besides the fact that it is probably unenforceable, it creates
inequity and unnecessary stress in this already troublesome time. We have already instituted
increased cleaning at our properties and are having discussions with our tenants about
temporary rent reductions which we are addressing on a case by case basis. Please do not pass
this proposed Declaration with the prohibition from charging rent – let us work out the economics
with each of our tenants. Thank you.

Hi Mary
I am writing you about the meeting you are having this evening , specifically the section that
would mandate Landlords cease collecting rent. I feel I need to offer a different persecutive
than one you might be getting.
Now is a very tough time businesses around the country. As a commercial building owner in
Hermosa Beach it is important to me that the downtown Hermosa business survive and
thrive. Not just important, but essential.
However, by mandating landlords not collect rent during this time, you would be unfairly shifting
the entire burden to Commercial property owners to a level that is very unfair. Please let me
explain:
1.Landlords still have pay insurance, pay the bank, maintain the property etc. The tenant
may be able to scale down their business, but the landlord can not. This is very unfair.
2.Some landlords relay on the income from their commercial property to survive. If you
were to mandate the landlord stop collecting rent, you would be cutting off their survival.
You might have situation where the business (tenant) survives, but the landlord is
devastated.
3.A restaurant under the proposed mandate could stay open (albeit in a reduced capacity)
because business are allows to scale their overhead. In this case the entire burden is
shifted to the property owners, who would be carrying the property without any income.
4.For voluntary closures, once again, the mandate would allows tenants to scale their
expense voluntarily, leaving landlords carrying the entire burden.
I have a tenant and I don’t want to loose them. A vacant building or desolate downtown
Hermosa serves no-one. Landlords suffer as does the tenant. Its a symbiotic relationship. So
please leave it to landlords and tenants to workout something out that is symbiotic. I know of at
least two fellow commercial building owners in Hermosa that say this mandate, should Hermosa
make it, will crush them. They can not make it without the income they get from rent.
Now is a very tough time for everyone. We all have to look out for each other. Please allow that
to happen is a way that the landlord and tenant have a chance to take care of each other and
work out a way they can both survive.
And at the very least, do not apply this mandate to voluntary closures.

I'm writing to you as a resident of Hermosa Beach, asking you to please consider following Mayor

eComment: While I understand the need for decisive action to try and help control the COVID-19
virus, I think that the City is overreaching with item 1b. It is not the City’s place to determine
whether the landlord or the tenant should bear the financial burden of the required closures.
Additionally, it is not clear what type of assistance the federal government may be providing to
businesses and individuals. At a minimum the City should wait until the federal assistance
package has been finalize before taking any action. The City should loosen regulations wherever
it can to help support these businesses during the closures. 1. The City should work with the
Chamber of Commerce to come up with a list of restaurants that will be offering takeout during
the restaurant closures. This list should be publicized on social media so residents know where
they can go to support their local businesses. 2. It is my understanding that some restaurants
have a restriction on offering take-out food in their CUPs. I suggest that the City relax these
restrictions during the . 3. The City should loosen signage rules to allow restaurants to publicize
that they are offering take-out food. 4. The City could allow personal trainers to conduct classes

Although the City Council values your comments, the Brown Act generally prohibits the
Council from taking action on any matter not listed on the posted agenda as a business
item. Out of an abundance of caution and due to the extraordinary nature of a
pandemic, the City of Hermosa Beach is taking additional precautions to reduce the
possibility of community transmission of the Novel Coronavirus (COVID-19). The City is
encouraging the submission of e-comments or email comment in place of in-person
public comment. Anyone wishing to make public comment in person, may do so from a
microphone in the Council Chambers lobby area in order to observe social distancing
guidelines. Comments from the public are limited to three minutes per speaker.

1. REPORT CITY COUNCIL DECLARATION OF AN EMERGENCY
20-0167 WITH ATTENDANT ORDERS
Recommendation:Staff recommends that the City Council adopt the attached resolution (to be added as a
supplemental item on Monday, March 16, 2020) ratifying the Proclamation of the
existence of a local emergency by the Mayor and further declaring as follows:
a. All restaurants, alcohol beverage establishments and snack shops in the City are
hereby ordered closed to onsite patronage until March 28, 2020.
i. Take-out orders and delivery of meals are permitted, provided that take-out orders
are picked up by a single person and the establishments maintain social distance in any
necessary queuing of patrons.
[ALTERNATIVELY: All restaurants, alcohol beverage establishments and snack shops
in the City are hereby ordered to reduce occupancies and remove or rearrange furniture
as necessary to implement social distancing standards]
b. Commercial landlords in the City are hereby prohibited from (i) charging rent or (ii)
evicting commercial tenants for nonpayment of rent with respect to tenants whose
businesses are subject to this Order or are otherwise closed (voluntarily or by mandate)
to prevent or reduce the spread of COVID-19. A landlord knows of a tenant's closure
within the meaning of this Order if the tenant, within 30 days after the date rent is due,
notifies the landlord in writing of such closure, and provides appropriate documentation
to support the claim. For purposes of this Order, "in writing" includes email or text
communications to a landlord or the landlord's representative with whom the tenant has
previously corresponded by email or text. Any financial information provided to the
landlord shall be held in confidence, and only used for evaluating the tenant's claim.
c. All formal and informal organized and group activities, games and sports, with the
exception of family outings, are hereby prohibited in all City parks and the beach.
d. The City shall post signs at all City parks advising that:
i. COVID-19 is known to survive on various surfaces such as children's play
equipment, bathroom surfaces, tables, benches, railings, and other fixtures, for 72 or
more hours; ii. Park users shall maintain social distance as prescribed by the Beach
Cities Health District; and
iii. Park users with symptoms consistent with COVID-19 infection are encouraged to
isolate themselves at home and contact their health care provider or, if they do not have
a health care provider, the City of Hermosa Beach Police Department to receive prompt
diagnosis and care.
e. Any other orders determined necessary by the City Council based on circumstances
as they exist at the time of the special meeting.
