RESOLUTION NO. 78-4211
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH,
CALIFORNIA, DECLARING ITS INTENTION TO INITIATE APPROPRIATE ACTION
BY THE PLANNING COMMISSION TO AMEND ZONING ORDINANCE NO. N. S. 154,
AS AMENDED, BY REVISING PROCEDURES FOR NOTICE OF PUBLIC HEARING.
THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That pursuant to the provisions of Article
15 of Zoning Ordinance No. N. S. 154, as amended, the City Council
does hereby resolve and declare its intention to initiate appro-
priate action by the Planning Commission of said City to amend
portions of said ordinance relating to the requirements for
notices of time and place of public hearings regarding zoning
matters, said proposed revisions to be worded as set forth below:
I. That Section 1605 of Zoning Ordinance No. N. S. 154, as
amended, shall be and is hereby amended to read as follows:
"Section 1605. Notices.
(A) Notice of time and place of a public hearing on any
amendment to the zoning ordinance which amendment does
not change any property from one zone to another or
impose any regulation set forth in subsection (C) below
or modify any such regulation heretofore imposed shall
be given by publication in a newspaper of general circu-
lation published and circulated in this City and shall
be given at least 10 calendar days prior to said
hearing; except that notices for public hearings
concerning conditional use permits and variances shall
require notice of said hearings to be given in accor-
dance with the requirements of subsection (B) below.
(B) Notice of public hearing upon an application for a
variance or a conditional use permit shall be given by
mailing a written notice to the owner(s) of the subject
property and to all owners of real property within a
radius of 300 feet of the exterior boundaries of the
3211 affected property at least 10 calendar days prior to

said hearing, with requirements for such public notice
to be established by resolution of the City Council.
(C) Written notice of a public hearing to be held to
consider a proposed amendment to or modification of the
zoning ordinance concerning matters listed below shall
be mailed to the owner(s) of the subject property and
to all owners of real property within a radius of 300
feet of the exterior boundaries of the affected property
and to all residents of said properties at least 10
calendar days prior to said hearing in accordance with
requirements for such public notice to be established by!
resolution of the City Council.
(a) Changing any property from one zone to another.
(b) Imposing or modifying any of the following regula-
tions as set forth within the zoning ordinance:
(1) The use of buildings, structures and land as
between industry, business, residents, open
space, including agriculture, recreation,
enjoyment of scenic beauty and use of natural
resources, and other purposes.
(2) Signs and billboards.
(3) Location, height, bulk, number of stories and
size of buildings and structures; the size and
use of lots, yards, courts and other open
spaces; the percentage of a lot which may be
occupied by a building or structure; the
intensity of land use.
(4) Requirements for off-street parking and
loading.
(5) Establishment and maintenance of building
setback lines.
(6) The creation of civic districts around civic

centers, public parks, public buildings or
public grounds and the establishment of
regulations therefor.
II. That Section 1510 of Zoning Ordinance No. N. S. 154, as
amended, shall be and is amended to read as follows:
"Section 1510. City Council to hold public hearing on
Commission's recommendations on amendments, and
on appeals.
Within not to exceed 40 days following receipt of the resolu-
tion from the Planning Commission recommending the adoption of the
amendment, or the filing of a written appeal from an order of the
I Planning Commission denying an application for amendment as pro-
vided in this article, the City Council shall conduct a duly
advertised public hearing on the matter, public notice of which
shall be given at least 10 days prior to said hearing according
to requirements established by resolution of the City Council."
III. That Sections 1405 and 1411 of Zoning Ordinance No. N. S.
154, as amended, shall be and are hereby amended to read
as follows:
"Section 1405. Notice and hearing on application for variance,
and conditional use permit.
Upon the filing of an application for a variance or a
conditional use permit by a property owner, or by a lessee with
the consent of the owner, the Planning Commission and/or Board of
Zoning Adjustment shall give notice to the applicant and may give
notice to any other interested person in the manner established by
resolution of the City Council of the intention to consider at a
public hearing the granting of a variance or conditional use
permit."
"Section 1411. Council to hold public hearing on appeal.
Within not to exceed 40 days following the receipt of the
written appeal the Council shall conduct a duly advertised public
hearing, public notice of which shall be given at least 10 days
prior to said hearing in accordance with requirements for such

1 notice as established by resolution of the City Council."
2 SECTION 2. That the Planning Commission shall hold a
3 duly noticed public hearing with regard to this action initiated
4 by the City Council, and announce its findings by formal resolu-
5 tion not more than 40 days following said hearing.
6 PASSED, APPROVED and ADOPTED this 10th day of May,
7 1978.

Hermosa Beach, California, do hereby certify that the foregoing
Resolution No. 78-4211 was duly and regularly passed, approved and
adopted by the City Council of the City of Hermosa Beach at an
adjourned regular meeting of said Council held at the regular
meeting place thereof on the loth day of May, 1978, by the
following vote:

Mayor Schmeltzer
