HomeMy WebLinkAboutRES-96-5813 (CUP/60-68 PIER AVENUE)1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 96-5813 A RESOLUTION OF THE CITY COUNCIL OF HERMOSA BEACH, CALIFORNIA, SUSTAINING THE DECISION OF THE PLANNING COMMISSION, ON APPEAL, TO APPROVE A CONDITIONAL USE PERMIT, AS AMENDED, TO ALLOW EXPANSION OF AN EXISTING RESTAURANT WITH ON -SALE ALCOHOL AND LIVE ENTERTAINMENT INTO THE ADJACENT BUILDING SPACE TO THE WEST AND TO ADD OUTSIDE DINING, AND ADOPTION OF A MITIGATED NEGATIVE DECLARATION AT 60-68 PIER AVENUE,, LEGALLY DESCRIBED AS LOTS 12 AND 13, BLOCK 12, HERMOSA BEACH TRACT WHEREAS, the City Council held a public hearing on June 25, 1996, to reconsider the I I Planning Commission's decision to approve the subject Conditional Use Permit and Parking Plan and to consider oral and written testimony on the matter, and; WHEREAS, the Planning Commission held a public hearing on the Conditional Use Permit I and Parking Plan at their meeting of May 21, 1996, and approved the request subject to conditions I as contained in Planning Commission resolution 96-23, and; WHEREAS, after considering the decision of the Planning Commission and their record of decision, and the testimony at the public hearing, the City Council agrees with the Planning I Commission, and agrees with the findings and the conditions contained within Planning Commission Resolution 96-23, which are incorporated herein by reference, NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL DOES HEREBY SUSTAIN THE DECISION OF THE PLANNING COMMISSION TO APPROVE A CONDITIONAL USE PERMIT, AS AMENDED, SUBJECT TO CONDITIONS AS SET FORTH IN P.C. Manhattan Beach, CA 90266 Phone: (310) 318-6267 NEGATIVE DECLARATION In accordance with Resolution 89-5229 of the City of Hermosa Beach, which implements the California Environmental Quality Act of 1970 in Hermosa Beach, the Environmental Review Committee must make an environmental review of all private projects proposed to be undertaken within the City, and the Planning Commission must make an environmental review of all public projects proposed to be undertaken within the City, which are subject to the Environmental Quality Act. This declaration is documentation of the review and, if it becomes final, no comprehensive Environmental Impact Report is required for this project. FINDING OF ENVIRONMENTAL REVIEW COMMITTEE We have undertaken and completed an Environmental Impact Review of this proposed project in accordance with Resolution 89-5229 of the City Council of Hermosa Beach, and find that this project does not require a comprehensive Environmental Impact Report because, provided the attached mitigation measures are included in the proje it would not have a significant effect on the environment. Documentation supporting this finding is on file in the Community Development Department, Planning Division.
