HomeMy WebLinkAboutRES 07-6565 (CALLING AND GIVING NOTICE-ELECTION)2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 07-6565 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, RESCINDING RESOLUTION NO. 07-6557, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 6, 2007, FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF AN ORDINANCE RELATING TO PIER PLAZA ON -SITE PARKING REQUIREMENTS, AND AMENDING RESOLUTION NOS. 07- 6558 AND 07-6559 TO DELETE ALL REFERENCES TO THE MEASURE WHEREAS, the City Council adopted Resolution No. 07-6557 on July 24, 2007, calling and giving notice of the holding of a General Municipal Election to be held on Tuesday, November 6, 2007, for the submission to the qualified voters of an ordinance relating to Pier Plaza on -site parking requirements; and WHEREAS, also on July 24, 2007, the City Council adopted Resolution No. 07-6558, requesting consolidation with the County of Los Angeles for two specified measures, and Resolution No. 07-6559, authorizing written arguments for the two measures; and WHEREAS, the City Council desires to repeal the ordinance as permitted by the California Elections Code, rather than to place it on the ballot; and WHERFikS, the City Council desires to rescind Resolution No. 07-6557 and withdraw the measure from the ballot. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council, pursuant to its right and authority, does hereby rescind Resolution No. 07-6557, and does hereby amend Resolution No. 07-6558 (regarding County consolidation) and Resolution No. 07-6559 (regarding written arguments) to delete the following question from the General Municipal Election of November 6, 2007: Shall Ordinance No. 17-1278 be adopted to exclude the expansion of YES buildings and new construction on properties on Pier Plaza west of Hermosa Avenue from the usual requirement that a minimum of 25% of NO required parking spaces be provided on the propL? 07-6565 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 3. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 4. That this resolution shall be effective immediately upon its passage. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution, shall enter the resolution into the book of original resolutions, and shall cause the action of the City Council in adopting same to be entered in the official minutes of said City Council.
