RESOLUTION NO. 14-6910
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, AUTHORIZING AND DIRECTING THE
COUNTY ASSESSOR TO SET UP A NEW HAULER ACCOUNT AND
FUND NUMBER FOR ARAKELIAN ENTERPRISES (ATHENS
SERVICES) IN ORDER TO INCLUDE DELINQUENT REFUSE BILLS AS
A SPECIAL ASSESSMENT TO BE COLLECTED AT THE SAME TIME
AND IN THE SAME MANNER AS COUNTY TAXES; AND TO INCLUDE
DELINQUENT REFUSE BILLS FROM CONSOLIDATED DISPOSAL
SERVICE (CDS) TO THEIR EXISTING FUND NUMBER
168.86 (HERMOSA BCH DEL REFUSE CDS) AS A SPECIAL
ASSESSMENT TO BE COLLECTED AT THE SAME TIME AND IN THE
SAME MANNER AS COUNTY TAXES
WHEREAS, Section 38790.1 of the California Government Code authorizes cities tol
collect delinquent refuse bills via a special assessment to be collected with county taxes; and
WHEREAS, the City Council adopted Ordinance No. 86-840 which provides for
collection of delinquent refuse bills in accordance with California Government Code
38790.1; and
WHEREAS, in accordance with Ordinance No. 86-840, property owners have ten days
from the date of the hearing to pay the delinquent refuse bill to avoid the special assessment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA
BEACH DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Each delinquent refuse bill shall be increased by an amount not to exceed
the actual costs incurred by the County of Los Angeles, and charged to the City of Hermosa Beach
for placing the delinquent refuse bills on the property tax roll via a special assessment.
SECTION 2. Each delinquent refuse bill shall be increased by fourteen dollars ($14.00) to
compensate the City of Hermosa Beach for the administrative costs incurred by collecting
delinquent refuse bills via a special assessment.

SECTION 3. Each delinquent refuse bill shall be increased by twenty-five dollars
($25.00) to compensate Consolidated Disposal Service for the administrative costs incurred in the
collection of delinquent refuse bills via a special assessment.
SECTION 4. The list of properties and the amount to be collected, attached as
Exhibit "A" for CDS and Exhibit "B" for Athens Services, shall be forwarded to the county
assessor for posting on the tax bill as a special assessment. Both Exhibit "A" and Exhibit "B" may
be modified by the City Manager to delete those parcels where delinquent refuse charges are paid
within ten (10) days following the City Council hearing.
SECTION 5. The City Clerk shall certify to the passage and adoption of this Resolution,
shall enter the same in the book of original Resolutions of said city; and shall make minutes of the
passage and adoption thereof in the records of the proceedings of the City Council at which the
same is passed and adopted.
SECTION 6. This Resolution supersedes Resolution No. 14-6903 (adopted by the City
Council June 24, 2014), which is hereby rescinded.

hereby certify that the foregoing Resolution No. 14-6910 was duly and regularly passed,
approved and adopted by the City Council of the City of Hermosa Beach at a Regular
Meeting of said Council at the regular place thereof on July 22, 2014.
