RESOLUTION NO. 15-6947
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HERMOSA BEACH, CALIFORNIA, APPROVING THE DESIGN AND
PLANS FOR THE CONSTRUCTION OF CIP NO. 14-402 SEWER
IMPROVEMENTS AT VARIOUS LOCATIONS PROJECT PURSUANT
TO GOVERNMENT CODE SECTION 830.6 AND ESTABLISHING A
PROJECT PAYMENT ACCOUNT
THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH DOES FIND,
RESOLVE AND DECLARE AS FOLLOWS:
WHEREAS, the City retained MBF Consulting, Inc. ("Consultant") as the engineer to
design and prepare the plans for CIP No. 14-402 Sewer Improvements at Various Locations
("Project");
WHEREAS, the Consultant informed the City Engineer that these plans are complete and
that construction of the Project may begin;
WHEREAS, the City Engineer reviewed the completed design and plans for the Project
and agrees with the Consultant that the plans are complete and the Project may be constructed; and
WHEREAS, the City Council wishes to obtain the immunities set forth in Government
Code § 830.6 with regard to the plans and construction of the Project.
Design Immunity; Authorization.
WHEREAS, the design and plans for the Project are determined to be consistent with the
City's standards and are approved;
WHEREAS, the design approval set forth in this Resolution occurred before actual work
on the Project construction commenced;
WHEREAS, the approval granted by this Resolution conforms with the City's General
Plan;

WHEREAS, the City Engineer, or designee, is authorized to act on the City's behalf in
approving any alterations or modifications of the design and plans approved by this Resolution;
and
WHEREAS, the approval and authorization granted by this Resolution is intended to avail
the City of the immunities set forth in Government Code § 830.6.
Project Payment Account.
For purposes of the Contract Documents administering the Project, the City Council direct:
the City Manager, or designee, to establish a fund containing sufficient monies from the Curren
fiscal year budget to pay for the Project ("Project Payment Account"). The Project paymen
Account is the sole source of funds available for the Contract Sum, as defined in the Contrac
Document administering the Project.
The City Clerk shall certify to the passage and adoption of this Resolution; shall enter the
same in the book of original Resolutions; and shall make a minute of the passage and adoption
thereof in the records of the proceedings of the City Council at which the same is passed and
adopted.

hereby certify that the foregoing Resolution No. 15-6947 was duly and regularly passed,

Meeting of said Council at the regular place thereof on March 24, 2015.
