RESOLUTION NO. 15-6983
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, ORDERING THE SUBMISSION TO THE QUALIFIED
VOTERS OF A PROPOSED ORDINANCE, SUBMITTED BY PETITION AND
REGARDING AN INCREASE OF THE TRANSIENT OCCUPANCY TAX
(HOTEL BED TAX) FROM 10% TO 12%, AT THE GENERAL MUNICIPAL
ELECTION TO BE HELD ON TUESDAY, NOVEMBER 3, 2015, AS CALLED BY
CITY COUNCIL RESOLUTION NO. 15-6973
WHEREAS, the City Council of the City of Hermosa Beach, at its meeting of June 23,
2015, adopted Resolution No. 15-6973, calling for the holding of a General Municipal Election
on Tuesday, November 3, 2015; and
WHEREAS, an initiative petition was filed June 9, 2015 with the City Clerk of the City
of Hermosa Beach, California, signed by more than five (5) percent of the number of Hermosa
Beach voters who cast votes at the gubernatorial election of November 4, 2014, pursuant to
Proposition 218, to submit to the voters a proposed ordinance that would increase the Transient
Occupancy Tax (Hotel Bed Tax) from 10% to 12% in Hermosa Beach; and
WHEREAS, the City Clerk examined the records of registration and ascertained that the
petition was signed by the requisite number of voters, and has so certified the results; and
WHEREAS, the City Council did not vote in favor of the adoption of the ordinance or
order a report pursuant to Section 9212 of the Elections Code of the State of California when the
certified petition was presented at the meeting of July 14, 2015; and
WHEREAS, the City Council is authorized and directed by California statute to submit
the proposed ordinance to the voters.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND
ORDER AS FOLLOWS:
SECTION 1. That pursuant to the requirements of the laws of the State of California,
the City Council of the City of Hermosa Beach does order submitted to the voters at the General
Municipal Election on Tuesday, November 3, 2015, the following question, which requires the
approval of a majority (50% plus 1) of those casting votes:

Shall an ordinance be adopted that would increase the Hermosa Beach
transient occupancy tax (hotel bed tax) from 10 percent to 12 percent of
room revenue?
YES
NO
SECTION 2. That the text of the ordinance submitted to the voters is attached as
Exhibit "A."
SECTION 3. That in all particulars not recited in this resolution, the election shall be
held and conducted as provided in Resolution No. 15-6973 and by law for holding municipal
elections.
SECTION 4. That notice of the time and place of holding the election is given and the
City Clerk is authorized, instructed and directed to give further or additional notice of the
election, in time, form and manner as required by law.
SECTION 5. That in the event the ordinance is approved by a majority vote of the
electors, and upon certification of the results of the November 3, 2015 election, the Mayor and
City Clerk are hereby authorized and directed to attest to said approval.
SECTION 9. That the City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original Resolutions, and shall make a minute of the
passage and adoption thereof in the minutes of the meeting at which the Resolution is adopted.

Meeting of said Council at the regular place thereof on July 14, 2015.
