Recitals. A. The City is statutorily authorized to prescribe fines for violations of municipal ordinances. That power does not extend to establishing bails for those violations. The authority to establish bails for violations within a county lies exclusively with the courts. California state law provides for the approval by the Superior Court of a schedule of bails for those offenses for which bail may be posted and forfeited; B. The current Bail Schedule for the City was last amended by Resolution No. 03- 6310 in 2003. In order for the Court to assess fines when a violator is found guilty or pleads no contest, the fines must be incorporated into the Court's bail schedule. Accordingly, it is necessary to periodically amend the bail schedule; C. The Bail Schedule has been reviewed by the City Manager, the City Attorney, the Hermosa Beach Police Department, and other staff members in the areas which involve violations within their supervision or jurisdiction; and D. The City Council desires to amend the City's Bail Schedule to include fines for newly adopted ordinances and to enable the Torrance Courthouse to accurately process citations in accordance with the City's Municipal Code. SECTION 2. The City Council hereby adopts the fines and penalties set forth in the City of Hermosa Beach "Bail Schedule" attached hereto as "Exhibit A," and incorporated herein by reference.
