RESOLUTION NO. 17-7088
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING THE AMENDED BAIL
SCHEDULE, AND REQUESTING THE PRESIDING JUDGE OF THE LOS
ANGELES SUPERIOR COURT TO APPROVE THE ATTACHED BAIL
SCHEDULE FOR MISDEMEANOR AND INFRACTION VIOLATIONS OF
THE MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA,
DOES HEREBY RESOLVE AND ORDER AS FOLLOWS:
SECTION 1. Recitals.
A. The City is statutorily authorized to prescribe fines for violations of municipal
ordinances. That power does not extend to establishing bails for those violations. The authority to
establish bails for violations within a county lies exclusively with the courts. California state law
provides for the approval by the Superior Court of a schedule of bails for those offenses for which
bail may be posted and forfeited;
B. The current Bail Schedule for the City was last amended by Resolution No. 03-
6310 in 2003. In order for the Court to assess fines when a violator is found guilty or pleads no
contest, the fines must be incorporated into the Court's bail schedule. Accordingly, it is necessary
to periodically amend the bail schedule;
C. The Bail Schedule has been reviewed by the City Manager, the City Attorney, the
Hermosa Beach Police Department, and other staff members in the areas which involve violations
within their supervision or jurisdiction; and
D. The City Council desires to amend the City's Bail Schedule to include fines for
newly adopted ordinances and to enable the Torrance Courthouse to accurately process citations in
accordance with the City's Municipal Code.
SECTION 2. The City Council hereby adopts the fines and penalties set forth in the City of
Hermosa Beach "Bail Schedule" attached hereto as "Exhibit A," and incorporated herein by
reference.

SECTION 3. The City Council hereby requests that the Superior Court of the County of
Los Angeles approves the attached recommended bail schedule for violations of the Municipal Code
of the City of Hermosa Beach, attached hereto as "Exhibit A."
SECTION 4. Resolution 96-5830, which was adopted by the City Council on September
10, 1996, is hereby rescinded. Resolution 03-6310, which was adopted by the City Council on
November 12, 2003, is hereby rescinded.
SECTION 5. This Resolution shall take effect immediately. The City Clerk shall certify
to the passage and adoption of this Resolution, shall cause the original of the same to be entered
among the original resolutions of the City Council and shall make a minute of the passage and
adoption thereof in the minutes of the City Council meeting at which the same is passed and adopted.

BAIL SCHEDULE — EXHIBIT A
RECLASSIFICATION OF MISDEMEANORS TO INFRACTIONS: Pursuant to Municipal
Code section 1.04.040, any code section which is classified as a misdemeanor may be charged
as an infraction if either a prosecutor charges it as an infraction or if the court, with consent of
the defendant, chooses to treat it as an infraction.
Additional provisions: Pursuant to Municipal Code section 1.04.050;
A. Unless otherwise specified, each person shall be guilty of a separate offense for each and
every day during any portion of which any violation of any provision of this Code is
committed, continued or permitted by such person and shall be punishable accordingly
B. Whenever in the Code any act or omission is made unlawful, it shall include causing,
permitting, aiding, abetting, suffering, or concealing the fact or such act of omission.
C. In addition to the penalties hereinabove provided, any condition caused or permitted to
exist in violation of any of the provisions of the Code shall be deemed a public nuisance
and may be summarily abated as such by the city, and every day such condition continues
shall be regarded as a new and separate offense.
SECTION 1.04.060 HOLIDAY SAFETY ENHANCEMENT LONE
A. Notwithstanding any provisions to the contrary, certain violations of this Code designated
as infractions in Chapters 9.04, 12.20 and 12.24 are separately designated therein as
misdemeanors if they occur within the boundaries of and during the effective dates and
times of the holiday safety enhancement zone.
B. The city council designates as the holiday safety enhancement zone the area bounded on
the north by the city of Manhattan Beach, on the south, by the city of Redondo Beach, on
the east by Valley Drive, and on the west by the Pacific Ocean, including the beach and
the municipal pier.
C. The holiday safety enhancement zone shall be in effect on Independence Day and New
Year's Day as follows:
1. When the holiday occurs on a Tuesday, Wednesday, or Thursday, the holiday
safety enhancement zone shall be in effect from 0800 a.m. on the day of the
holiday to 0600 a.m. on the following day.
2. When the holiday occurs on a Friday, Saturday, Sunday, or Monday, the holiday
safety enhancement zone shall be in effect from 0800 a.m. on Friday to 0600 a.m.
on the following Tuesday.
D. The holiday safety enhancement zone shall be in effect on Memorial Day and Labor Day
from 0800 a.m. on the Friday immediately preceding the holiday to 0600 a.m. on the
Tuesday immediately following the holiday.
