HomeMy WebLinkAboutRES-86-4942 (ZONE/LOT MERGER)1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 86- 4942 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, EVIDENCING ITS INTENT TO SEND TO THE PLANNING COMMISSION A CHARGE TO HOLD A PUBLIC HEARING AND INVESTIGATE WHAT STEPS ARE NECESSARY TO ALLEVIATE PROBLEMS CAUSED BY INDIVIDUAL DEVELOPMENT OF CONTIGUOUS LOTS WITH COMMON OWNERSHIP AND TO MAKE RECOMMENDATIONS REGARDING THE IMPLEMENTATION OF A LOT MERGER ORDINANCE MERGING LOTS WHERE AT LEAST ONE OF THE CONTIGUOUS PARCELS OR UNITS OF LAND HELD BY THE SAME OWNER DOES NOT CONFORM TO STANDARDS FOR MINIMUM LOT SIZE IN THE R-1 AND R-2 ZONES. WHEREAS, the City Council has amsidered =adopt Avg. arv, emxgep,�,-- ordinance suspending building permit issuances while the City may study the serious problem of overdevelopment of the City by individual development of contiguous lots with common ownership comprising less than the minimum iot size in the R-1 and R-2 Zones; WHEREAS, the City Council desires that a thorough study of the matter be made by the Planning Commission so as to recommend reasonable solutions to this problem while will benefit the citizens of the City of Hermosa Beach; WHEREAS, the serious nature of this problem requires immediate action by the Planning Commission which shall include the setting of public hearings to determine whether a lot merger ordinance should be adopted pursuant to the California Government Code so as to allow the City of Hermosa Beach to merge 2/resol -1- on U `1. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 substandard lots in a manner consistent with Government Code Sections 66451.11; WHEREAS, immediate action is required by the Planning Com- mission so that this matter may be returned to the City Council as soon as possible for resolution to protect the citizens of the City and to eliminate uncertainty in development; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH DOES RESOLVE AS FOLLOWS: Section 1. That the Planning Commission be charged to study and hold public hearings to determine whether or not a lot merger ordinance should be adopted pursuant to Government Code Section 66451.11. Section 2. That the scope of the study shall include review of measures to alleviate problems caused by individual development of contiguous lots with common ownership and to make recommendations regarding the implementation of a lot merger ordinance, merging lots where at least one of the contiguous parcels or units of land held by the same owner does not conform to the standards for minimum lot size in the R-1 and R-2 Zones. Section 3. That a public hearing be set on this matter before the Planning Commission on June 17t4 1986 so that citizens may be heard on this subject and give public testimony regarding the necessity of such a lot merger ordinance. Section 4. That the Planning Commission shall, no later than July 11 1986, return this matter to the City Council with a report including any proposed ordinances recommended by the Commission to the City Council so that it may begin procedures to, determine what steps, if any, should be implemented. 2/resol -2- 1 2 3 4 5 6 7 8 9 10 11 12 i�i 14 15 17 18 19 20 21 22 23 24 25 26 27 28 Section 5. That the City Clerk publish this resolution in the Easy Reader in the manner provided in Government Code Section 6061. PASSED, APPROVED AND ADOPTED ON THIS 27th DAY OF May 1986.
