HomeMy WebLinkAboutORD NO. 18-1386 (SCOOTERS)2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 ?R ORDINANCE NO. 18-1386 AN ORDINANCE OF THE CITY OF HERMOSA BEACH, CALIFORNIA, AMENDING SECTIONS 12.28.090 AND 12.28.100 OF TITLE 12 (STREET, SIDEWALKS, AND PUBLIC PLACES) OF THE HERMOSA BEACH MUNICIPAL CODE TO ALLOW SCOOTERS IN PUBLICALLY OWNED OR OPERATED SKATEBOARD FACILITIES THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Since March, 2018, the Parks, Recreation and Community Re Advisory Commission (Commission) and the City Council have held several deliberations regardi the use of scooters in the Skate Park, which resulted in a trial period beginning on May 1, 2018 allow their use. Staff returned to the Commission at its June 5, 2018 meeting to report that th( were no issues or concerns resulting from the shared use of equipment in the skate park during t: time. The Commission unanimously recommended formalizing the policy update and related cc sections to allow the use of scooters. SECTION 2. The Hermosa Beach City Council properly reviewed and considered this matter on August 28, 2018. Public Notice of the hearing was published on August 16, 2018. SECTION 3. Environmental Review. This Ordinance was assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The City Council hereby finds that the Ordinance is exempt from the requirements of CEQA pursuant to CEQA Guidelines Section 15301 as an action taken by a regulatory agency that involves negligible or no expansion of an existing use. SECTION 4. Section 12.28.090 of Title 12 (Street, Sidewalks, and Public Places) of the Hermosa Beach Municipal Code is amended to read as follows: 12.28.090 Designated in -line skate and scooter areas. The following areas are designated recreational areas in which the operation of in -line skates and scooters are permitted: any publicly owned or publicly operated skateboard facility, unless otherwise specifically excluded from this designation by resolution of the City Council. No motorized devices, including but not limited to motorized skates, skateboards, or scooters, shall be operated within any publicly owned or publicly operated skateboard facility. SECTION 5. Section 12.28.100 of Title 12 (Street, Sidewalks, and Public Places) of the Hermosa Beach Municipal Code is amended to read as follows: 12.28.100 Requirements for the use of publicly owned or publicly operated skateboard facilities. Every person riding a skateboard, in -line skates, or a scooter at a publicly owned or publicly operated facility that is designed and maintained for the purpose of recreational skateboard use must wear a helmet, elbow pads, and knee pads. SECTION 6. This Ordinance shall become effective and be in full force and effect from and after thirty (30) days of its final passage and adoption. SECTION 7. The City Clerk shall cause this Ordinance to be published in a newspaper of general circulation published and circulated in the City within fifteen (15) days after its passage. SECTION 8. The City Clerk shall certify to the passage of this Ordinance, shall enter the same in the book of original ordinances of said city, and shall make minutes of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted.
