ORDINANCE NO. 17-1374
AN ORDINANCE OF THE CITY OF HERMOSA BEACH, CALIFORNIA,
AMENDING CHAPTER 13.12 OF THE HERMOSA BEACH MUNICIPAL
CODE REGARDING REBATES FOR THE SEWER SERVICE CHARGE
THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. A new Section 13.12.050 is added to Chapter 13.12 of Title 13 of the
Hermosa Beach Municipal Code to read as follows:
13.12.50 Rebates
A. Property owners shall be eligible for an annual rebate of 100% of the sewer service
charge paid per year for the dwelling unit in which the owner resides provided that the individual:
1. Is a senior citizen aged sixty-five and older or is permanently disabled;
2. Has an annual household gross income of $75,000 and under;
3. Has paid the charge in full on or prior to the date the charge would have been
deemed delinquent if not paid; and
4. Has resided in the dwelling unit for which the rebate is sought as of the date the
charge was levied against the dwelling unit.
For purposes of this section, a "permanently disabled" person is any person who has a
physical or mental impairment that substantially limits one or more of the major life activities, and
who identifies himself or herself as permanently disabled.
B. Applications for a rebate shall be made on a form provided by the City, and shall be
accompanied by (1) a signed affidavit declaring (a) household income and (b) age, or that the
person identifies himself or herself as permanently disabled as the result of a physical or mental
impairment that substantially limits one or more of the major life activities, and (2) proof of
payment of the charge in a form satisfactory to the City. Applications for a rebate shall be made
within one hundred eighty days of the date the sewer service charge would have been deemed
delinquent if not paid in full. The City Manager, or his/her designee, may promulgate rules and
regulations to effectuate the purpose of this section.

C. The rebates authorized under this Section shall be provided from any of the City's
non -restricted funds.
SECTION 2. Retroactive Application. Notwithstanding Section 13.12.50.13 above,
applications for rebates for charges paid on the 2015-2016 property tax roll may be submitted,
accepted, processed and paid if submitted to the City by July 30, 2017.
SECTION 3. This Ordinance was assessed in accordance with the authority and criteria
contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines (the
Guidelines), and the environmental regulations of the City. The City Council hereby finds that
under Section 15061(b)(3) of the State CEQA Guidelines, this Ordinance is exempt from the
requirements of CEQA because it can be seen with certainty that the provisions contained herein
would not have the potential for causing a significant effect on the environment.
SECTION 4. The City Clerk shall cause this Ordinance to be published in a newspaper of
general circulation published and circulated in the City within fifteen (15) days after its passage.
SECTION 5. The City Clerk shall certify to the passage of this Ordinance; shall enter the
same, together with the certification and proof of publication, in the book of original ordinances of
said city; and shall make minutes of the passage and adoption thereof in the records of the
proceedings of the City Council at which the same is passed and adopted.

hereby certify that the foregoing Ordinance No. 17-1374 was duly and regularly passed,
approved and adopted by the City Council of the City of Hermosa Beach at a Regular
meeting held at the regular meeting place thereof on the 14th day of February, 2017, and
the Ordinance will be published in the Easy Reader newspaper on February 23, 2017.
