ORDINANCE NO. 17-1376
AN ORDINANCE OF THE CITY OF HERMOSA BEACH, CALIFORNIA,
REPEALING CHAPTER 21A OF THE HERMOSA BEACH MUNICIPAL
CODE ("HERMOSA BEACH OIL CODE")
THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Recitals.
A. Pursuant to Section 5.56.010 of the Hermosa Beach Municipal Code, oil and gas
exploration, drilling, recovery and production is prohibited within the City of Hermosa Beach.
B. Chapter 21A of the Municipal Code was adopted by Ordinance No. 85-803 in
1985, at a time when oil and gas drilling and recovery was a permitted use.
C. In light of the prohibition of oil and gas exploration, drilling, recovery and
production, and the extinguishment of all rights to oil recovery in the March 6, 2017 Settlement
Agreement between the City and E&B Natural Resources Management Corporation, Chapter 21 A
is obsolete and should be repealed.
SECTION 2. Chapter 21A (Oil Code) of the Hermosa Beach Municipal Code is hereby
repealed in its entirety.
SECTION 3. This Ordinance shall become effective and be in full force and effect from
and after thirty (30) days of its final passage and adoption.
SECTION 4. The City Clerk shall cause this Ordinance to be published in a newspaper of
general circulation published and circulated in the City within fifteen (15) days after its passage.

SECTION 5. The City Clerk shall certify to the passage of this Ordinance, shall enter the
same in the book of original ordinances of said city, and shall make minutes of the passage and
adoption thereof in the records of the proceedings of the City Council at which the same is passed
and adopted.
PASSED, APPROVED and ADOPTED this 23rd day of May, 2017 by the following vote:

and the Ordinance will be published in the Easy Reader on June 1, 2017.
