HomeMy WebLinkAboutORD-16-1373 (ELECTIONS)2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 16-1373 AN ORDINANCE OF THE CITY OF HERMOSA BEACH, CALIFORNIA, MOVING THE DATE OF THE CITY'S GENERAL MUNICIPAL ELECTION FROM THE FIRST TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER OF ODD -NUMBERED YEARS TO THE FIRST TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER OF EVEN -NUMBERED YEARS BEGINNING IN NOVEMBER 2022 THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. A. The City of Hermosa Beach currently consolidates with the County of Los Angeles to conduct General Municipal Elections on the first Tuesday after the first Monday in November of each odd -numbered year. B. Senate Bill 415 was signed by the Governor in September 2015 and, commencing January 1, 2018, prohibits a political subdivision, as defined, from holding an election other than on a statewide election date, if holding a regularly scheduled election in that political subdivision on a non -concurrent date has previously resulted in voter turnout at least 25% less than the average voter turnout within the political subdivision for the previous four statewide general elections. C. The City of Hermosa Beach does not meet the qualifying criteria to continue to conduct its elections in November of odd -numbered years and must move its elections to the date of the statewide general election. SECTION 2. The City wishes to change its election date and consolidate its elections with the statewide general election conducted by the County of Los Angeles on the Tuesday after the first Monday in November of even -numbered years, beginning November 2022. SECTION 3. Pursuant to Section 1301 of the Elections Code of the State of California, the City will continue to hold its elections on the first Tuesday after the first Monday in November of each odd -numbered year until such time as the County approves the consolidation of future general municipal elections. If the County approves the City's request, pursuant to Section 10403(b) of the Elections Code, no elected City office term affected by a subsequent adjustment to City election dates by ordinance shall be increased or decreased by more than 12 months. SECTION 5. Pursuant to Elections Code Section 1301, the City requests the County of Los Angeles to approve consolidation of the City's general municipal elections with the statewide general elections beginning in November 2022. SECTION 6. Pursuant to Elections Code Sections 1301 and 10403.5, this ordinance shall not become operative until approved by the Los Angeles -County Board of Supervisors. SECTION 7. Pursuant to Elections Code Section 10403.5(e), within 30 days after the ordinance becomes operative, the City's election official (City Clerk) shall cause a notice to be mailed to City of Hermosa Beach registered voters. SECTION 8. The City Clerk shall forward a copy of the ordinance to the Los Angeles County Registrar -Recorder and Los Angeles County Board of Supervisors requesting approval by Board Resolution. SECTION 9. The City Clerk shall certify to the passage and adoption of this ordinance, shall enter the same in the book of original ordinances of said city; shall make minutes of the passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted.
