HomeMy WebLinkAboutORD NO. 09-1297 (PARKING METER)Honorable Mayor and Members of the Hermosa Beach City Council January 5, 2009 City Council Meeting of January 13, 2009 ADOPTION OF ORDINANCE AMENDING THE HERMOSA BEACH MUNICIPAL CODE (HBMC) TO INDICATE THAT METER RATES ARE SET BY RESOLUTION RECOMMENDATION: It is recommended that the City Council adopt the attached Ordinance 09- which amends the HBMC to indicate that meter rates shall be set by resolution and to remove the actual rate from the code. BACKGROUND: It has come to our attention that Section 10.36.010, paragraph A of the HBMC contains an outdated meter rate and requires the rate to be changed by ordinance instead of by resolution. ANALYSIS: Typically, rates are set by resolution rather than being written into the Municipal Code to refrain from having to reprint the code every time a rate is changed. Adoption of the attached ordinance removes the rate from the code and requires rates to be set by resolution (which is how the rates have been set in the past). Chapter 10.36, Section 10.36.010, Paragraph A, of the Hermosa Beach Municipal Code is hereby amended to read as follows: A. Parking meter zones are those streets or portions of streets or public parking lots established by Ordinance as zones within which the parking of vehicles may be controlled, regulated and inspected with the aid of parking meters. In the event that no parking meters are installed in any parking space within such parking meter zones, the maximum time for parking shall be as specified by this code or by Resolution of the City Council. Parking meter rates throughout the City shall be determined by Resolution of the City Council. SECTION 2. This Ordinance shall become effective and be in full force and effect from and after thirty (30) days of its final passage and adoption. SECTION 3. Prior to the expiration of fifteen (15) days after the date of its adoption, the City Clerk shall cause this Ordinance to be published in the Easy Reader, a weekly newspaper of general circulation published and circulated, in the City of Hermosa Beach in the manner provided by law. SECTION 4. The City Clerk shall certify to the passage and adoption of this Ordinance, shall enter the same in the book of original Ordinances of said city, and shall make minutes of the 09-1297 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 passage and adoption thereof in the records of the proceedings of the City Council at which the same is passed and adopted.
