THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Findings. The City Council of the City of Hermosa Beach, California,
hereby finds as follows:
A. Subsidizing applications for the designation of historic landmarks within the
City is in the public interest for the reasons fully set forth in Hermosa Beach
Municipal Code Section 17.53.020, including: (1) to safeguard the City’s
heritage by encouraging the protection of landmarks representing
significant elements of its history; (2) to foster civic and neighborhood pride
and a sense of identity based on an appreciation of the City’s past and the
recognition and use of historic resources; (3) to enhance the visual
character of the City by preserving diverse architectural styles reflecting
phases of the City’s history and by encouraging complementary
contemporary design and construction; (4) to strengthen the economy of
the City by protecting and enhancing the City’s attractions to residents,
tourists, and visitors; (5) to stabilize and improve property values within the
City by recognizing historic landmarks and by protecting areas of historic
buildings from encroachment by incompatible designs; (6) to promote the
enjoyment and use of historic resources appropriate for the education and
recreation of the people of the City; (7) to integrate the preservation of
historic resources appropriate for the education and recreation of the
people of the City; (8) to conserve valuable material and energy resources

by ongoing use and maintenance of the existing built environment; and (9)
to take whatever steps are reasonable and necessary to safeguard the
property rights of owners whose property is declared to be a landmark.
B. The City of Hermosa Beach adopted Resolution No 16-7045 (“Master Fee
Resolution”) to establish fees and charges for certain services provided by
the City and penalties for violation of certain provisions of the Municipal
Code.
C. Chapter 17.53 (Historic Resources Preservation) of Title 17 (Zoning) was
adopted by the City Council of the City of Hermosa Beach on November
10, 1998 through its Ordinance No. 98-1186.
D. The purpose of the City’s Historic Resources Preservation Ordinance is to
promote the public health, safety, and general welfare by providing for the
identification, protection, enhancement, perpetuation, and use of historic
resources such as buildings, structures, sites, and places within the City that
reflect special elements of the City’s architectural, artistic, cultural,
historical, political, and social heritage.
E. Applicants with a sufficient ownership interest in a particular eligible historic
resource may apply to nominate that property to become a landmark.
(HBMC § 17.53.070.) The City’s Master Fee Resolution requires payment of
an application fee to accompany applications for the historic designation
of a site under Chapter 17.53. The application process may involve the
review or report of a historic preservationist, architect, or similar
professional(s). Generally, the applicant also bears the cost of this third-
party professional review.
F. Payment of the above costs can be financially burdensome to residential
property owners, especially those who have owned their homes for many
years.

G. Waiving the costs identified in Recital E for worthy applications serves to
incentivize property owners to nominate their properties as a historic
resource for the benefit of the community.
H. In an effort to support qualifying applicants, the City desires to provide
Historic Resources Preservation application fee waiver opportunities to assist
with relieving the financial burden associated with petitioning the City for
the historic designation of a particular residential landmark, building,
resource, or site.
SECTION 2. This Historic Resources Preservation Application Fee Waiver Policy (the
“Policy”) is intended for those eligible residential structures that are, in the sole
and exclusive judgment of the City based on a prima facie review of the
application materials, likely to satisfy the application filing, review, and approval
process.
SECTION 3. Under the Policy, the City would waive, for eligible applicants, up to
90% of the application fee otherwise required under the Master Fee Resolution to
file a Historic Resources Preservation application through a special waiver process
(“Waiver Applications”). In addition, the City would waive up to 90% of the costs
associated with the preparation of reports, documentation, or evidence by a
suitable professional(s).
SECTION 4. In order to be eligible to apply for a Waiver Application, a proposed
application must meet the following generally applicable criteria:
A. The structure proposed to become a historic landmark is a residential
structure;
B. The structure is older than 50 years of age; and

C. The structure, after a preliminary review by City staff, is likely to satisfy the
criteria for historic landmark designation under Hermosa Beach Municipal
Code Chapter 17.53, in the sole and exclusive judgment of the City’s
Community Development Department.
SECTION 5. The City will only consider a maximum of two (2) Waiver Applications
per fiscal year. In addition, the maximum dollar amount waived and/or cost of
application processing absorbed by the City will be $10,000 per application.
SECTION 6. The City’s Community Development Department is tasked with
reviewing and determining the propriety of awarding a Waiver Application. Fee
waivers may be granted when the City, through its designee(s), determines that
the proposed landmark is of significant value to the community under the factors
outlined in the City’s Historic Landmark Preservation Ordinance and this Policy.
SECTION 7. Subject to the requirements and criteria of this Resolution, the
Community Development Department is hereby authorized to approve Waiver
Applications, notwithstanding the provisions of the City’s Master Fee resolution.
SECTION 8. This Policy has no effect on the requirements, standards, procedures,
and review associated with the Historic Resources Preservation Ordinance as
codified under Hermosa Beach Municipal Code Chapter 17.53. This Policy does
not create any additional right in any individual, group, or applicant. The City
expressly reserves the right to modify, suspend, or terminate this Policy at any time
and without warning.

SECTION 9. A certified copy of this resolution shall be filed in the office of the City
Clerk and open to public inspection.
SECTION 10. This Resolution shall take effect immediately. The City Clerk shall
certify to the passage and adoption of this Resolution, shall cause the original of
the same to be entered among the original resolutions of the City Council, and
shall make a minute of the passage and adoption thereof in the minutes of the
City Council meeting at which the same is passed and adopted.
