HomeMy WebLinkAboutBZA 154-449,I RESOLUTION B.Z.A. 154-449 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 2000 STRAND, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on February 1, 1982, in the Council Chambers of the City Hall, considered the request of Dr. Irwin Cooper to add 31%, t·o · a: sirigler -family dwelling being conilerted from an illegal duplex, said addition to increase lot coverage to 87.83%, to maintain existing nonconforming sideyard setbacks, front yard setback and rear yard set- back, and to provide zero usable open space; on property legally des- cribed as Lot 1, Block 21, Hermosa Beach Tract; and WHEREAS, at said public hearing, the applicant stated that in doing this addition he is also adding a third garage space; there will be a spa area in a greenhouse-type environment on the first floor between the buildings; that he discussed the plans with the immediate neighbors and all were in favor of the proposed variance; and WHEREAS, at said public hearing, one neighbor appeared and nine neigh- bors signed in a petition, all in favor of the project; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justifie~ subject to conditions~ for the following reasons: 1 . That there are exceptional or extraordinary circumstances or condi- tions applicable to the property involved because the building was constructed in 1927 which predates existing code; it is in an unusual location in that it is surrounded on three sides by approxi- mately 2100 sq. ft. of public open space; the deficiency on the north side is one half of a foot, which is relatively minor in nature; allowing this variance would convert an illegal duplex through the deed restriction to a single family use on the lot; there would be an additional third parking space on the property through this variance; the applicant is willing to install and maintain, with Council's approval, landscaping in the City's right- of-way adjacent to the site. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because similar variances have been granted in the same vicinity and zone in the recent past. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because of the unique circumstances (the surrounding open space), the mass- ing of the building is not injurious to the neighboring properties or improvements in such vicinity and zone; there were nine signa- tures of adjacent properties that were in f~vor of granting the variance; there were no objections at the public hearing. -Continued - I PAGE 2 -RESOLUTION B.Z.A. 154-449 2000 STRAND, HERMOSA BEACH 4. That the granting of such variance will not adversely affect the comprehensive General Plan because through the deed restrict- ion, it will keep the property in less dense development than would be allowed by the Zoning Code. AND, FURTHER, that this variance is granted subject to the following condition: 1. That a deed restriction be required limiting the building to single family usage. NOW, THEREFORE, BE IT RESOLVED, that in view of the above finding of fact, the Board of Zoning Adjustments of the City of Hermosa Beach does hereby grant the request by the following vote: AYES: Comms. Cutler, Ebey, Merrill, Chmn. DeBellis NOES: Comm. Moore ABSENT: Comms.
