HomeMy WebLinkAboutBZA 154-457RESOLUTION B.Z.A. 154-457 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 541 -24TH PLACE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on April 19, 1982 in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. Ronald Croft for permission to add 65.75% to an existing single family dwelling with a nonconforming 3½ ft. easterly sideyard setback in lieu of the 5' required; the proposed addition to meet all yard requirements; on property legally described as Lot 7, Block 2, Hermosa Park Tract; and WHEREAS, at said public hearing, the applicant stated that his setback was legal when the building was built in 1955; and he would be willing to sign a deed restriction; and WHEREAS, at said public hearing, the neighbor to the east of the prop- erty spoke in favor of the request; also a petition was submitted con- taining the signatures of four neighbors in support and no one appeared to speak in opposition; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the request is justified, subject to conditions, for the following reasons: 1. That there are exceptional or extraordinary circumstances or condi- tions applicable to the property involved because the house was conforming when built in 1955; the 3½ ft. sideyard has posed no problem in the past, in fact, it reflects the sideyard that many lots have as conforming today. 2. That such _ variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because the Board has granted similar variances; the applicants are not asking to continue the sideyard. 3. That the granting of such variance will not be materially detri- mental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because it would not have any effect on light or air or make any hazard for adjoining property; one person appeared at the public hearing in favor of the proposed variance; and a petition was submitted supporting the request. 4. That the granting of such variance will not adversely affect the comprehensive General Plan because it does not change the density, and the applicant agreed to sign a deed restriction limiting the use to single family. AND, FURTHER, that the variance is granted subject to the following condition: That a deed restriction be executed limiting the use of the property to a single family dwelling. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments of the City of Hermosa Beach does -Continued - PAGE 2 -RESOLUTION B.Z.A. 154-457 541 -24TH PLACE, HERMOSA BEACH hereby grant the request by the following vote: AYES: Comms. Cutler, Ebey, Merrill, Toth, Chmn. Moore NOES: None ABSENT: Comms.
