A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT
580 -21ST STREET~ HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on uune 7, 1982 in Room 8 of the Community
Center considered the request of Mr. Larry Heiller for permission to
add 86% to a single family dwelling with an existing nonconforming
westerly sideyard setback of 3 1 6" in lieu of the 5' required, and to
provide a 4 1 6 1 ' west sideyard with the addition; on property legally
described as Lot 45 & E. 10' of Lot 44, Tract 1868; and'
WHEREAS, at said public hearing, the applicant submitted a photograph
of a nearby property with a similar sideyard setback and explained
tha:t the reason he was asking for the extra 6" with the addition was
to provide a reasonable walkway for the nursery; and
WHEREAS, at said public hearing, no one appeared to speak in opposi-
tion to the request and two people signed a petition in favor of
the variance; and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that the request is justified for the following
reasons:
1. There are , exceptional or extraordinary circumstances or conditions
applicable to the property involved because the building is a two-
bedroom, den, one bathroom home which was built in 1951 and pre-
dates existing code; it is not adequate in its present form for
a family of 4, especially when the children are of both sexes;
the new construction will have an additional 1 ft. sideyard clear-
ance.
2. The variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same
vicinity and zone, and denied to the property in question because
the proposed addition blends well architecturally with the exist-
ing houses; the new structure is located entirely to the rear of
the existing home and will not be very noticeable from the street.
3. The granting of the variance will not be materially detrimental
to the public welfare or injurious to the property or improvements
in such vicinity and zone in which the property is located because
the existing side yard has been that way for 25 years and has not
affected the neighborhood adversely; the area of proposed non-
conforming sideyard is not contiguous to any neighboring structure;
the existing trees and fencing will maintain the privacy of the
neighbors' as it is now.
4. Granting the variance will not adversely affect the comprehensive
General Plan because the unit will remain a single family dwelling.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments does hereby grant the variance
by the following vote:
AYES: Comms. DeBellis, Merrill, Toth, Williams, Chmn. Moore
NOES: None
ABSENT: Comms. Cutler, Ebey
