HomeMy WebLinkAboutBZA 154-463RESOLUTION B.Z.A. 154-463 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 572 -18TH STREET ., HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on Jurie 7, 1982 in Rbom 8 of the Community Center, considered the request of Mr. and Mrs. Jim Liebscher for permission to add 54.27% to an existing single family residence with a nonconforming 2'4" east sideyard and to maintain the nonconformity with the addition; on property legally described as NW 45' of Lot 10, Block 71, 2nd Addition to Hermosa Beach Tract; and WHEREAS, at said public hearing, the applicant stated the house was built in 1949 and there are a number of properties in the area that have similar reduced setbacks and submitted photographs of four examples; and WHEREAS, at said public hearing, a petition signed by five residents of the area was submitted in favor of the project; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the request is justified for the following reasons: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved because the existing house was built in 1949 with a reduced sideyard; if the addition were moved in to conform with the legal setback, there would be almost no light available to the kitchen and limited access to the backyard. 2. The variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because a number of properties in the immediate area have similar reduced setbacks on the original house and the addition; similar variances have been .granted on Valley Park Street. 3. That g~anting the variance will not be materially detrimental to the public welfare or·injurious to the property or improvements in such vicinity and zone in which the property is located because the setback is already established by the position of the1 house; there is sufficient access for fire protection; no one appeared to speak in opposition at the public hearing; six resident neighbors signed a petition in favor of the variance, including the most- affected neighbor. . 4. The granting of the variance will not adversely affect the general plan because use and occupancy of the property will not be changed. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. DeBellis, Merrill, Toth, Williams NOES: Chmn. Moore ABSENT: Comms.
