HomeMy WebLinkAboutBZA 154-464RESOLUTION B.Z.A. 154-464 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT 2618 MANHATTAN AVENUE, HERMOSA BEACH~ CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on June 29, 1982, at the Hermosa Beach Com- munity .Center considered the request of Mr. and Mrs. Brenner Dorland for permission to add a second unit to the rear of an existing single family dwelling with nonconforming front yard setback and a noncon- forming 2'11" south sideyard and to conform to the required setbacks with addition; to increase the existing 50.61% lot coverage to 73.77%; also to provide less than the required usable open space; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the usable open space requirement in the R-3 zone is 200 sq. ft. per dwelling unit, half of which may be in decks; that the plans show a 165 sq.ft. deck and a 39 sq.ft. deck, the smaller of which does not meet minimum dimension requirements, and the larger deck can only account for 50% (100 sq.ft.) of the required open space for the new unit; that the required front yard setback is 10 ft., the current setback being 6'2" at ground floor and 4' at the second floor; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the request is not justified for the following reasons: 1. That they could find no exceptional or extraordinary circumstances or conditions for allowing the addition of a second unit when code could not be met. 2. That the plans do require a significant lowering of the required open space, and therefore it would be materially detrimental to the neighbors. 3. That granting the variance would increase the density on this lot above the maximum allowable by the General Plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby deny the variance by the following vote: AYES: Comms. DeBellis, Ebey, Merrill, Williams, Chmn. Moore NOES: None ABSENT: Comms.
