HomeMy WebLinkAboutBZA 154-465RESOLUTION B.Z.A. 154-465 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 29 -19TH STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on June 29, 1982 at the Community Center, considered the request of Mr. and Mrs. James Parker for permission to add a second unit on an R-2B lot providing less than the required usable open space; on property legally described as Lot 25, Block 20, Hermosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the R-2B zone requires 300 sq. ft. of usable open space per dwelling unit; that the proposed open space is 405 sq.ft.; that the above property is located on a walk street and the applicants utilize a 20 x 37 ft. area of City property as part of their front yard as with all walk street properties; and WHEREAS, at said public hearing, the applicant stated that the fact that his lot is wider than other on the block should be taken into consideration; and WHEREAS, at said public hearing, a petition containing the signatures of four of the immediate neighbors was submitted in support of the request and no one appeared to speak in opposition; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because it does abut City property with 740 sq. ft. of open space; there appears to be no feasible constructional alternative that would provide the usable .open space on the property itself. 2. That such variance is necessary for the preservation and enjoy- ment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because it predates existing code; others have been granted the same right in the same vicinity and zone. S. That the granting of such variance will not be materially detri- mental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because it does not substantially reduce, light, air, open space, and the fact that it is next to 740 sq.ft. of usable open space mitigates any impacts; all of the adjacent property owners signed a petition in favor of the variance; no one appeared to speak in opposition at the public hearing. 4. That the granting of such variance will not adversely affect the comprehensive General Plan because it does not exceed the density allowed by the general plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of -Continued - I PAGE 2 -RESOLUTION B.Z.A. 154-465 29 -19TH STREET fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. DeBellis, Ebey, Merrill, Williams, Chmn. Moore NOES: None ABSENT: Comms. Cutler, Toth CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-465 was adopted by the Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the 29th day of June, 1982.
