A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT
1512 PROSPECT AVENUE, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on July 19, 1982 in the Council Chambers of
the City Hall, considered the request of Nanci Grube for permission to
add more than 40% to an existing single family dwelling with an exist-
ing nonconfcirming north side yard setback of 2' and to maintain the
nonconformity with the second story addition, on property legally des-
cribed as Lot 14, Tract 1562; and
WHEREAS, at said public hearing, the applicant pointed out that the
existing building is only 912 sq. ft. in size and the second floor is
needed to provide an additional bedroom, bathroom and office; and
WHEREAS, at said public hearing, no one appeared to speak in opposition
to the request and two signatures of immediate neighbors were submitted
in favor of the request; and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that the request is justified for the following
reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because the building was
constructed in 1949 which predates existing Code; the addition of
a second story that would conform with sideyards would be except-
ionally difficult; this constitutes an extraordinary circumstance
that has occurred in many other buildings in town.
2. That such variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity .and zone, and denied to the property in question
because this variance is necessary to enable the owner to create a
second story; it is a right that has been enjoyed by many other
properties in the same vicinity and zone.
3. That the granting of such variance will not be materially detrimental
to the public welfare or injurious to the property or improvements
in such vicinity and zone in which the property is located because
the variance will not encroach further on ground clearance problems,
ground footprint of the building; there was no opposition at the
public hearing; both neighbors adjacent to the property in question
indicated their approval of the project.
4. That the granting of such variance will not adversely affect the
comprehensive General Plan because this will not affect the use of
the land.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments does hereby grant the variance by
the following vote:
AYES: Cornms. Cutler, DeBellis, Merrill, Williams, Chmn. Moore
NOES: None
ABSENT: Comms. Ebey, Toth

CERTIFICATION
