HomeMy WebLinkAboutBZA 154-470RESOLUTION B.Z.A. 154-470 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1160 CYPRESS AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on July 19, 1982 in the Council Chambers of the City Hall, considered the request of Gary and Maude Feil for per- mission to add more than 40% to an existing single family dwelling with a nonconforming 3'6'' sideyard in lieu of the 4' required; said addition to conform to the required setback, on property legally des- cribed as Lot 9, Tract 780; and WHEREAS, at said public hearing, the applicants' representative stated the existing residence is only 1000 sq. ft. in size and the variance will allow a bedroom, bath, sitting area and deck at the second level; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning ,Adjustments that the request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or condi- tions applicable to the property involved because the building was built before 1947 which predates existing Code; to bring the build- ing into conformity would be exceptionally difficult; the second story addition meets the requirements of a 40 ft. wide lot. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because many other properties in the same vicinity and zone are able to build second stories, many of them with minor variances of this sort. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the second story meets all the setback requirements of the current Code and does not have a negative effect on air and light circula- tion; there is no change .to the ground floor footprint of the build- ing; there was no negative input at the public hearing or in writing to the Board. 4. That the granting of such variance will not adversely affect the com- prehensive General Plan because this project does not change the use of the property which is acceptable under the General Plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments hereby grants the variance by the following vote: AYES: Comms. Cutler, DeBellis, Merrill, Williams, Chmn. Moore NOES: None ABSENT: Comms.
