HomeMy WebLinkAboutBZA 154-475RESOLUTION B.Z.A. 154-475 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1654 LOMA DRIVE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 2, 1982, ,in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. Herbert Bishop for permission to add more than 40% to an existing single family dwel- ling with a nonconforming south sideyard setback of 1 ft. and a north sideyard setback of 2'3½" in lieu of the 3' required; the addition to conform to present code requirements; on property legally described as Lot 1, Hiss Addition to Hermosa Beach Tract; and WHEREAS, at said public hearing, the applicants stated they presently use the house as a sunimer home; however, they wish to retire and would like to make the house more livable for a permanent home; and they are willing to agree to a deed restriction; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and a petition was submitted in favor of the project; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the request is justified, subject to conditions, for the following reasons: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved because the original structure was built prior to 1932 which predates existing sideyard require- ments; reconstructing the building in order to meet the sideyard requirement would be an undue burden, and the addition itself meets the current sideyard requirements and all other particulars in the Zoning Code. 2. That the variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because there is no other way to add to this building than to apply for the variance; the ability to enjoy the development of a person's property has been enjoyed by other persons in the same vicinity and zone, and the addition does conform. 3. That the granting of such variance will not be materially detri- mental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the addition meets all requirements of the Zoning Code and, therefore, on its face, does not interfere with police or safety access to the property or interfere with light, air circulation; a substantial number of neighbors signed a petition in favor of the project; and there was no negative input either in writing or at the public hearing. 4. That the granting of such variance does not adversely affect the comprehensive General Plan because it does not change the current use which is within the limits of the General Plan. AND, FURTHER, that the variance is granted subject to the following condition: That a deed restriction be executed limiting the use of the property to a single family residence. -Continued - PAGE 2 -RESOLUTION B.Z.A. 154-475 1654 LOMA DRIVE, HERMOSA BEACH NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. Cutler, Merrill, Williams, Chmn. Moore NOES: None ABSENT: Comms.
