A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT
3419 MANHATTAN AVENUE, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on August 2, 1982, in the Council Chambers of
the City Hall, considered the request of Mr. and Mrs. Peter Rodgers
for permission to be allowed a ~stair leadin~ from the second level of
a single residence to a deck encroaching into the required sideyard of
3.84' to within 1.35' of the property lirie and increasing the lot cov-
erage by 4.36%; on property legally .described as S. 1/2 of Lot 14,
Block 101, Shakespeare Tract; and
WHEREAS, at said public hearing~.the applicant's representative stated
if an interior stairway were provided, a significant amount of square
footage would be lost, and there was no reasonable alternative to the
outside stairway; and
WHEREAS, at said public hearing, no one appeared to speak in opposition
to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that the request is justified for the following
reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because the construction
project requires some other solution than an ianterior stairway to
avoid a significant impact on the square footage to the second
floor.
2. That such variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity and zone, and denied to the property in question
because other properties have been able to be developed in this
vicinity and zone and have .required variance to do so.
3. That the granting of such variance will not be materially detri-
mental to the public welfare or injurious to the property or improve-
ments in such vicinity and zone in which the property is located
because the basic project does not restrict air, police, fire
safety; the variance encroachment is at the second story level and
does not affect movement of people on the ground floor and is along
an alley.
4. That the granting of such variance will not adversely affect the
comprehensive General Plan because it does not change the use of
the structure.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments does hereby grant the variance
by the following vote:
AYES: Comms. Cutler, Merrill, Williams, Chmn. Moore
NOES: None
ABSENT: Comms. DeBEllis, Ebey, Toth
