A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT
1728 MONTEREY BOULEVARD, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on August 16, 1982 in the Council Chambers
of the City Hall, considered the request of John and Marilyn Neuhart
for permission to add more than 40% to a single family residence with
a nonconforming south sideyard of 2.26', maintaining the same noncon-
formity with the addition; also to increase the lot coverage to 66.8%,
on property legally described as Lot 16, Tract 1128; and
WHEREAS, at said public hearing, the applicants stated they would ;
agree to a deed restriction limiting the property with the addition to
single family use; and
WHEREAS, at said public hearing, written communication was received
from the two adjacent property owners in support of the request and
no one appeared to speak in opposition; and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that the request is justified, subject to conditions,
for the following reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because the existing resi-
dence already has the nonconforming setbacks existing and, wherever
practicable with the new construction, the owners are meeting the
setback requirements.
2. That such variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity and zone, and denied to the property in question
because such a variance allows a second level to be created without
having to reconstruct new supports for the new level, but instead
allows the use of existing construction for support.
3. That the granting of such variance will not be materially detri-
mental to the public welfare or injurious to the property or improve-
ments in such vicinity and zone in which the property is located
because the Board received the adjacent property owners' signatures
favoring the variance; no one appeared to speak in opposition; the
applicants have agreed to a deed restriction limiting the use to
single family dwelling; the project does not seriously affect
police/fire access or light and air circulation around the building.
4. The granting of the variance does not adversely affect the compre-
hensive General Plan because it does not change the use and the
applicants have agreed to sign a deed restriction.
AND, FURTHER, that this variance is granted subject to the following
condition:
1. That a deed restriction be required limiting the property
to a single family residence.

NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments does hereby grant the variance
by the following vote:
AYES: Comms. Ebey, Toth, Williams, Chmn. Moore
NOES: None
ABSENT: Comms. Cutler, DeBellis, Merrill
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-478 was adopted
by the Board of Zoning Adjustments of the City of Hermosa Beach at a
regular meeting held on the 16th day of August, 1982.
