HomeMy WebLinkAboutBZA 154-479RESOLUTION B,_Z.A. 154-479 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 459 LONGFELLOW AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS~ the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 16, 1982" in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. Samuel Shaffer for permission to add a second story to an existing single family dwelling and to demolish a single car garage and build a new two-car garage; said building has a nonconforming east sideyard of .8' at the building with entry encroaching onto city property and the addition will increase the lot coverage to 66.55%; and WHEREAS, at said public hearing, the following facts were presented for consideration; th•t this property has exceptional circumstances as it was discovered when the survey was done for this addition that an error had been made when the tract was created and this lot is approximately 3 ft. narrower than shown 9n the Tax Assessor's plat book and the Title Deed to the property; and WHEREAS, at said public hearing, the applicant's representative stated that the loft shown on the plans is to be completely eliminated; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zon- ing Adjustments that the variance is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or condi- tions applicable to the property involved because of the error in the property line location and the request for continuation of the side- yard encroachment is along a City street side rather than an adjac- ent lot. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because it enables them to utilize this property in the same way other properties in the vicinity and zone are allowed if it were not for the sideyard error. 3. That the granting of such variance will not be materially detri- mental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the nonconformity is along the street side and does not materially affect light and air circulation or access to fire safety personnel or any other public concern. 4. That the granting of such variance will not adversely affect the comprehensive General Plan because it does not change the use of the property. NOW, THEREFORE, BE IT RESOLVED that the Board of Zoning Adjustments does hereby grant the request by the following vote: -Continued - , \.
