A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT
1120 LOMA DRIVE, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on October 18, 1982 in the Council Chambers of
the City Hall considered the request of Mr. Rob Saemann for permission
to add a unit over an existing garage that has a nonconforming rear
yard setback of 2' in lieu of the 5' required and to maintain the 2'
at the upper level with the deck only; on property legally described
as Lot 11, Block 1, Hiss 2nd Addition to Hermosa Beach Tract; and
WHEREAS, at said public hearing, the following facts were presented
for consideration; that the parking will be provided by two spaces
within the garage and two open spaces in front of the garage; and
WHEREAS, at said public hearing, the applicant stated that the existing
back wall of the garage sits on a retaining wall; therefore, the eleva-
tion of the neighbors' house is actually six feet lower than the wall;
and
WHEREAS, at said public hearing, no one appeared to speak in opposition
to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that the variance request is justified for the fol-
lowing reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because the garage has
been existing for a long time; because of the slope from the back
and the addition being set in to the required depth, there would
be no additional significant infringement on air or light for the
adjacent property.
2. That such variance is necessary f or the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity and zone, and denied to the property in question
because a number of other properties in the same vicinity and sharing
that zoning have more than one residence on the property with greater
coverage than the property in question.
3. That the granting of such variance will not be materially detri-
mental to the public welfare or injurious to the property or improve-
ments in such vicinity and zone in which the property is located
because the variance maintains it within the lot density of the
area.
4. That the granting of such variance will not adversely affect the
comprehensive General Plan because it is in conformity with same.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact , the Board of Zoning Adjustments of the City of Hermosa Beach does
hereby grant the variance by the following vote:
AYES: Comms. Cutler, Ebey, Toth, Chmn. Moore
NOES: None
ABSENT: Comm. Williams

CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-484 was adopted
