A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT
437 -31ST STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on October 18, 1982, in· the Council Chambers
of the City Hall, considered the request of Mr. Thomas Lee for permis-
sion to add to an existing single family residence with nonconforming
front yard setback of 4.45' in lieu of 7 ft. required and a noncon-
forming west sideyard setback varying from 2.8' to 2.92', and to main-
tain the nonconformities with the second story addition; on property
legally described as Lot 19, Block 124, Shakespeare Tract; and
WHEREAS, at said public hearing, the applicant stated he was present
to answer any questions the Board might have; and
WHEREAS, at said public hearing, no one appeared to speak in opposition
to the request; and
WHEREAS, after due consideration, it is the opinion of the Board that
the request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because in order to bring
it into conformity, the applicant would have to have major struct-
ural changes to the existing building.
2. That such variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity and zone, and denied to the property in question
because the property right of this nonconformity is typical of the
street and of the area and zone, and it asks nothing exceptional of
the other property owners that they do not already enjoy.
3. That the granting of such variance will not be materially detrimental
to the public welfare or injurious to the property or improvements
in such vicinity and zone in which the property is located because
there will be no significant impact on air or light to surrounding
properties.
4. That the granting of such variance will not adversely affect the
comprehensive General Plan because there is no change in use.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments does hereby approve the variance
by the following vote:
AYES: Comms. Cutler, Ebey, Toth, Chmn. Moore
NOES: none
ABSENT: Comm. Williams
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-486 was adopted
by the Board of Zoning Adjustments of the City of Hermosa Beach at a
regular meeting held on the 18th day of October, 1982.
