A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT
3408-3410 HIGHLAND AVENUE, HERMOSA BEACH ., CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on October 18, 1982 in the Council Chambers
of the City Hall, considered the request of Mr. Robert C. Fleming for
permission to make i 15 ft~ extension to a two-car garage that , has a
nonconforming south sidejard setback of 2.23' in order to convert a
portion of the existing garage into a bedroom and bath to be used
with the lower unit of a duplex; on property legally described as
Lot 2, Block 122, Shakespeare Tract; and
WHEREAS, at said public hearing, the applicant stated that the upper
unit is built over the existing garage making it economically infeas-
ible to move the building by .77'; that the existing 21' apron behind
the garage is not required parking; and
WHEREAS, at said public hearing, :it was noted that the neighbor to the
south and the one most affected by the request has submitted her signa-
ture in favor of the request; and
WHEREAS, after due consideration, it is the opinion of two members of
the Board of Zoning Adjustments that the request is not justified in
that the extension will take away two parking spaces, required or not;
and
WHEREAS, after due consideration, it is the opinion of two members of
the Board of Zoning Adjustments that the request is justified in that
the parking spaces on the apron behind the garage are not required
spaces and the only issue before the Board is the south sideyard set-
back;
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings, the
Board of Zoning Adjustments does hereby deny the request for variance
by a split vote:
AYES: Comms. Cutler, Ebey
NOES: Comm. Toth, Chmn. Moore
ABSENT: Comm. Williams
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-487 was adopted
by the Board of Zoning Adjustments of the City of Hermosa Beach at a
regular meeting held on the 18th day of October, 1982.
