B .z .A. 154-34 RESOLUTION:
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS RECOMMENDING CERTAIN
ACTION UPON PROPERTY LOCATED AT 421 MONTEREY AVENUE, HERMOSA BEACH, TO
THE CITY COUNCIL OF HERMOSA BEACH, CALIFORNIA.
THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DOES RESOLVE AS
FOLLOWS:
WHEREAS, there was filed with this Board under the prov1s1ons of Ordinance
N.S. 154, an application for a variance by Albert Wayne Unruh upon property
owned by the applicant and located at 421 Monterey Blvd.; and
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach did on
October 12, 1970, conduct a public hearing to consider this application to
convert an existing single family residence with an existing one-car garage in
an R-3 zone into three units providing two additional parking spaces 8.5 ft.
wide by 21 ft. deep in lieu of the two-car garage and one parking stall that
would be required; and
WHEREAS, The Board of Zoning Adjustments did at said duly advertised public hearing
adopt Resolution B.Z.A. 154-28 denying this application; and
WHEREAS, reconsideration of this application has been requested by the City
Counci 1;
NOW, THEREFORE BE IT RESOLVED that after reconsideration of the action taken
in Resolution B.Z.A. 154-28 on October 12, 1970 to deny application of Albert
Wayne Unruh to convert an existing single-family residence with a one-car garage
into three units providing two open parking spaces 8.5 1 wide by 21' deep, it is
the reco11V11endation of the Board of Zoning Adjustments that the variance be
granted for the following reasons:
1. Additional testimony indicates that t he property has been used as three units
for long periods of time in the past, and the owner, Mr. Unruh, would be
denied the same rights as other property owners in the area if the variance
den i a 1 i s uphe 1 d.
2. The granting of this variance would not adversely affect the comprehensive
General Plan.
3. It has been demonstrated that the denial of this variance would constitute
an undue hardship as Mr. Unruh understood in purchasing the dwelling that
it was a legal 3-unit residence.
The foregoing Resolution was adopted by the Board of Zoning Adjustments at a
regular meeting held November 23, 1970, by the following vote:
AYES: Comm. Ostermann, Comm. Lagan, Chairman Richard Williams
NOES: None
CERTIFICATION
I hereby certify that the foregoing Resolution B.Z.A. 154-34 was adopted by the
Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting
held on this 23rd day of November, 1970.
