HomeMy WebLinkAboutBZA 154-37RESOLUTION: NAME: TO PERMIT: BZA 154-37 BOB 1 S BIG BOY, INC. CONSTRUCTION OF RESTAURANT WITH ZERO FOOT SETBACK IN LIEU OF REQUIRED THREE FOOT REAR SETBACK. A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE WHICH WOULD PERMIT ZERO (o) FOOT REAR SETBACK IN LIEU OF REQUIRED THREE (3) FOOT SETBACK ON A PROPOSED RESTAURANT TO BE CONSTRUCTED AT 1025 PACIFIC COAST HIGHWAY: LEGALLY DESCRIBED AS LOT I OF TRACT 223, AND LOT 1, BLOCK 2, OF TRACT 6851, HERMOSA BEACH, CALIF. THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DOES RESOLVE AS FOLLOWS: WHEREAS, there was filed with this Board under the provisions of Ordinance N.S. 154, an application for a variance by Bob 1 s Big Boy, Inc. upon property leased by applicant and located at 1025 Pacific Coast Highway: Lot 1 of Tract 223, and Lot 1, Block 2, of Tract 6851, Hermosa Beach, California, and WHEREAS, The Board of Zoning Adjustments of the City of Hermosa Beach did on January 25, 1971, conduct a public hearing to consider this application to permit a zero (0) rear setback for a proposed restaurant to be constructed, in 1 ieu of the required three (3) foot rear setback, and WHEREAS, at s-aid public hearing, there was presented written and oral testimony on the property described as follows: Lot I of Tract 223, and Lot I, Block 2, of Tract 6851, known as 1025 Pacific Coast Highway. NOW, THEREFORE, BE IT RESOLVED, that in view of the findings at said hearing, The Board of Zoning Adjustments does hereby grant this variance for the following reasons: I. The requested variance will not be detrimental to surrounding property owners, since the encroachment to zero foot rear setback will involve only that portion of the building which is to be constructed along the north- west line. This particular section of the structure does not abut other properties, but I ies along a twenty foot wide alley, and therefore, will not interfere with I ight or ventilation. 2. There will be no traffic problems with ingress or egress since the applicant has two other places of access along Pacific Coast Highway and the alley is not a through alley which might be used by the general public. 3. There would be no conflict with the Comprehensive General Plan. The foregoing Resolution was adopted by the Board of Zoning Adj LS tments at a regular meeting held January 25, 1971, by the following vote: AYES: Comm.
