HomeMy WebLinkAboutBZA 154-41RESOLUTION: NAME: LOCATION: BZA 154-41 SUNNYGLEN CONSTRUCTION CO. 414 SECOND STREET TO PERMIT: THIRD FLOOR BALCONIES ENCROACHMENT INTO 5' SIDEYARDS A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE WHICH WOULD PERMIT THIRD FLOOR BALCONIES IN APARTMENT COMPLEX TO ENCROACH INTO REQUIRED 5' SIDEYARDS A MAXIMUM OF TWO FEET, SAID SIDEYARDS BEING ON A SIDE STREEI'. PROPERTY LOCATED AT 414 S~OND STREEI', LEGALLY DESCRIBED AS PER MRI'ES AND BOUNDS IN DESCRIPTION EXHIBIT "A" AS SUBMITTED. THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DOES RESOLVE AS FOLLOWS: WHEREAS, there was filed with this Board under the provisions of Ordinance N.S. 154, an application for a variance by Sunnyglen Construction Co mpany up on property owned by applicant and located at 414 Second Street, legally described a s parcels 1 through 6 of exhibit "A" metes and bounds in de scription as submitted, Her mosa Beach, Calif- ornia,' and tvHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach did on April 19, 1971, conduct a public hearing to consider this application for a variance to permit third floor balconies in apartment complex to encroach into required 5' sideyards a maximum of two feet, and WHERE.AS, at said public hearing, there was presented written and oral testimony on the property described as follows: Parcels 1 through 6 of exhibit "A" metes and bounds in description as submitted, known as 414 Second Street, NOW, THEREFORE BE IT RESOLVED, that in view of the findings at said hearing, the Board of Zoning Adjustments does hereby grant this variance for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, said encroachment being located on a street side will not interfere with light and ventilation of surrounding properties. 2. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. J. That the granting of such variance will not adversely affect the compre- hensive general plan. The foregoing Resolution was adopted by the Board of Zoning Adjustments at a regular meeting held April 19, 1971, by the following vote: AYES: Coimn. Lagan, Osterman, Chairman Williams NOES: None CERTIFICATION I hereby certify that the foregoing Resolution BZA 1.54-41 was adopted by the Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on this 19th day of April, 1971.
