HomeMy WebLinkAboutBZA 154-43RESOLUTION: BZA 154-43 NAME: LOCATION: JANET HASEHEIER & VINCENT PICKETT 2124 HERMOSA AVENUE TO PERMIT: BALCONY ENCROACHMENT INTO FRONT YARD SETBACK A -RESOLUTION OF _ THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMQSA BEACH GRANTING A VARIANCE TO BUILD A THREE STORY APARTMENT WITH SIX UNITS, FIRST FLOOR TO COMPLY WITH THE 10 FT. REQUIRED FRONT SETBACK, SECOND AND THIRD FLOORS TO ENCROACH A MAXIMUM OF 5 FT. INTO THE REQUIRED 10 FT. FRONT SETBACK; OPEN BALCONIES ON SECOND AND THIRD FLOORS TO ENCROACH AT THE NORTH END OF THE BUILD- ING TO WITHIN 1 FT. OF FRONT PROPERTY LINE, AND ON THE SOUTH END OF THE BUILDING, BALCONIES TO ENCROACH TO WITHIN APPROXIMATELY 2 FT. OF FRONT PROPERTY LINE. THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DOES RESOLVE AS FOLLOWS: WHEREAS, there was filed with this Board under the provisions of Ordinance N.S. 154, an application for a variance by Janet Hasemeier and Vincent Pickett upon property owned by applicants and located at 2124 Hermosa Avenue, legally described as Lot 3, Block 31, 1st Addition to Hermosa Beach, California, and WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach did on May 17, 1971, conduct a public hearing to consider this application for a variance to permit second and third floors to encroach a maximum of 5 ft. into required 10 ft. front setback; open balconies on second and third floors to encroach at north end of build- ing to within 1 ft. of front property line, and on south end of building to within approximately 2 ft. of front property line, and WHEREAS, at said public hearing, there was presented written and oral testimony on the property described as follows: Lot 3, Block 31, 1st Addition to Hermosa Beach, known as 2124 Hermosa Avenue, NOW, THEREFORE BE IT RESOLVED, that in view of the findings at said hearing, the Board of Zoning Adjustments does hereby grant this variance for the following reasons: I. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved due to the steep slope and angle of the lots in this area. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the compre- hensive general plan. 5. That a very similar version of this variance was granted in the past and the addition of the balconies would not be materially detrimental to the public welfare and would probably be superior to the previous application. The foregoing Resolution BZA 154-43 was adopted by the Board of Zoning Adjustments at a regular meeting held May 17, 1971, by the following vote: AYES: Convn. Alton, Co11JT1. Basila, Conm.
