HomeMy WebLinkAboutBZA 154-44RESOLUTION: BZA 154-44 NAME: LOCATION: JOEL AND CHARLOTTE DANIEL 611 PORTER LANE TO PERMIT: ADDITION TO EXISTING BUILDING WITH NONCONFORMING SIDEYARD ON ATTACHED GARAGE A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE TO BUILD A SECOND STORY ON EXISTING SINGLE FAMILY RESIDENCE WITH NONCONFORMING SIDEVARD ON WEST SIDE; ADDITION TO BE GREATER THAN 40% OF GROSS FLOOR AREA OF EXISTING STRUCTURE. THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DOES RESOLVE AS FOLLOWS: WHEREAS, there was filed with this Board under the provisions of Ordinance N.S. 154, an application for a variance by Joel and Charlotte Daniel upon property owned by appl i- cants and located at 611 Porter Lane, legally described as Lot 22, Tract 16915, Hermosa Beach, California, and WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach did on June 7, 1971, conduct a public hearing to consider this application for a variance to permit construction of a second story on existing family residence with nonconforming side- yard on west side of attached garage; addition to be greater than 40% of gross floor area of existing structure, and WHEREAS, at said public hearing, there was presented written and oral testimony on the property described as follows: Lot 22, Tract 16915, known as 611 Porter Lane, NOW, THEREFORE BE IT RESOLVED, that in view of the findings at said hearing, the Board of Zoning Adjustments does hereby grant this variance for the following reasons: 1. There are exceptional circumstances applicable to the property involved due to the garage encroachment which was legal at the time building was constructed and a similar encroachment of the majority of homes in this area. 2. The granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 3. That the granting of such variance will not adversely affect the compre- hensive general plan. The foregoing Resolution BZA 154-44 was adopted by the Board of Zoning Adjustments at a regular meeting held June 7, 1971, by the following vote: AVES: Conm.
