HomeMy WebLinkAboutPC Resolution 82-31n ( u RESOLUTION P.C. 82-Jl A RESOLUTION OF THE PLANNING COMMISSION OF HERMOSA BEACH APPROVING RE- VISIONS TO THE ZONING CODE, CHAPTER 9.5, ARTICLES III & V COMJ'.IBRCIAL/ INDUSTRIAL CONDOMINIUMS. WHEREAS, the Planning Commission held public hearings on both September 7 and 21 of 1982 to consider this matter; and WHEREAS, the Planning Commission has determined that Articles III and V of Chapter 9.5 of the zoning code are not adequately equiped to allow for proper review of development projects; and WHEREAS, the Planning Commission has determined that such inadequacies impact the major aspects of both Articles III and V, namely, permits required, CC and R's, general design standards and tenant assistance. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of Hermosa Beach does hereby recommend to the City Council, revisions to the zoning code, Chapter 9.5, Articles III and V of the Commercial/Industrial Condo- minium ordinance as represented in the enclosed attachments. Delete all mention of HIC 2. Purpose J. CC&R 1 s 4. General design standards. n NEW CONSTRUCTION: 1. Section 9.5-31 (e) delete mention of HIC 2. Section 9.5-31 (h) delete mention of outdoor space and storage space 3. Section 9.5-34 (f) delete the following phrase 11 less than three-fourths (3/4) butn so as to be consistent with residential condominium ordinance. Section 9.5-34 (h) addition of requirement that within thirty (30) days of submitting CC&R 1 s to the Depa.Ttment of Real Estate, applicant is to provide City with a certified copy of such CC&R's so recorded. 4-Section 9.5-35 (f) creation of new subsection to include the following: No commercial condominium project shall be required to provide setbacks, except as required by a precise plan . .All commercial condominium pro- jects shall comply with Article 800, Section 805 Placement of Buildings • .All condominium projects shall comply with parking requirements stipulated in .Article 11.5 of the zoning code. And when the intensity of use is increased through the addition of floor area or change in use, additional parking and loading shall be provided. Furthermore, a minimum of two parking spaces per unit shall be required . .All condominium projects shall comply with the fire, plumbing and elec-· trical codes of the City . .All industrial condominium projects shall be reQuired to comply with .Article 9 of the zoning code. All condominium projects shall be required to provide for provision of a smoke detection system which rings a local alarm system and transmits a signal to the Fire Department dispatch. Section 9 .5-31 Additiona l requirements for conditional use permits a pplicat ion shall be: A history of occupancy report i ncluding- *rental r ate history for past five years *nature of existing tenant businesses and length of tenancy *est imated sale prices of unit s . 2. Section 9 .5-44 s hall b e amended as follows : * new subsection (I) which will read (I) after filing application to convert, all new tenants shall be inf'ormed in writing of such, and s hall not be eligible for moving expenses . * new subsection (J) shich will read (J) no conve rsion shall be a pproved unless the propose d con v e rsion will not delete a significant number of offi ce, commercial or industrial units from the Cit y 1 s commer- cial stock at a t ime when reasonable replacement or equivalent units are not readily available . * new subsection (K) which will read (K) t he applicant has not en- gaged in r etaliatory act i on regarding the tenants in order t o coerce them into supporting the application for conversion . * amend s ubsection (C) to re~uire moving expenses , as a result o f t he conversion, due and_ payable·· at the . time of: mov il}g ·.and ~_qual· to · th.ree-·,montb.s rent . * amend subsec tion ( G) addition ·or t he word 11 or11 in t he t hird sentence of sub section. Hence, sub section ( G) s hall read 11 No increase i n rents. A tenants rent shall not be increased for one year from the time of the filing o f the request f or permit or until r elocation takes p lace or until t he project is denied or withdrawn ." J. Section 9 .5-35 addition of "additionally, when the intensity of use is increased through the addition of t he f loor area or change in use, addition al parking and loading for such increased use shall provide in a ccordance with Article 11 .5 of the zoning code. Furthermore , a minimum of two parking spaces p er unit shall be r equired. Each unit shall h ave i ts own electric meter and shut-off system, and t he same shall appl y to gas when it is possi b le. This r equirement is t o be met within sixty (60) days of closing of escrow. Section 9.5-55 delete subsections (E) and (F); (E) relates to l aundry facilities (F) relates to storage r oom 4. Section 9.5-63 delete this section; relates to c onditional approval.
