RESOLUTION B.Z.A. 154-201
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH
GRANTING A VARIANCE TO ENCROACH INTO THE REQUIRED FRONT YARD SETBACK ON PROP-
ERTY LOCATED AT 2025 CIRCLE DRIVE, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on August 2, 1976, in the Council Chambers of the City Hall, considered
the request of Mr. Robert G. Edlefsen for permission to encroach into the required
front yard setback to property line with the construction of two sundecks, on prop-
erty known as Lot 13, Tract 3853; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that, should the variance be granted, the structure would not obstruct the view for
vehicles coming around the corner even if the street were widened; and
WHEREAS, at said public hearing, the applicant stated that he understands the need
for setback requirements; that he feels the setback requi'rement may already have
been met on Circle Drive; that the drawing of the deck extends onto City property;
that should the Board grant the frontyard encroachment, he could construct a usable
deck to the property line even if City Council denied the public property encroach-
ment; that aesthetically it would be better to construct the decks as proposed; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the
request; and
WHEREAS, at said public hearing, a petition was presented signed by ten residents
of the area in support of the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the proper.ty involved because the strict application of the
ordinance in this case may create an undue hardship in that the original
structure was developed to other standards and has already met the require~
ments for the setback.
2. That the variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because there are structures
built up to the property line on the same street and in other areas of Her-
mosa Beach.
3. That the granting of the variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vic-
inity and zone in which the property is located because it does not infringe
upon any other adjoining properties.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because no new units are created and would have no impact
on the use of the General Plan.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
AYES: Comms. Collins, Cummings, Sims, Chmn. Ebey
NOES: Comm. Ebey
ABSENT: Comm. Toth

CERTIFICATION
I hereby certify that the foregoing Resolution B.Z.A. 154-201 was adopted by the
