A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH
GRANTING A VARIANCE TO MAKE STRUCTURAL ALTERATIONS (ADDITION) TO A: NONCON-
FORMING PROPERTY LOCATED AT 3010 HERMOSA AVENUE, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on August 2, 1976, in the Council Chambers of the City Hall, consid-
ered the request of Mr. and Mrs. Thomas C. Mason for permission to make structural
alterations in excess of 40% to an existing nonconforming property with a noncon-
forming garage by width and depth, and with a nonconforming northerly sideyard, on
property known as Lot 4, Block 105, Shakespeare Tract; and
WHEREAS, at said public hearing, the following facts were presented for consideration,
that the request is necessary in order that the applicant would be allowed to make
any structural alterations to the existing nonconforming property due to the noncon-
forming sideyard; that it would be difficult to widen the existing garage, however,
lengthening it could be explored; and
WHEREAS, at said public hearing, the applicant stated he would be willing to add to
the length of the garage; however, it would be very difficult and expensive to widen
it; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the var-
iance request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjust-
ments that the variance request is justified, subject to conditions, for the following
reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because any other placement of the garage
space would have created undue hardship on the applicant.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and
zone, and denied to the property in question because there are other properties
in the same area with nonconforming garages and nonconforming sideyards.
3. That the granting of such variance •tll not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and
zone in which the property is located because the addition does not encroach upon
any other adjacent properties.
4. That the granting of the variance will not adversely affect the comprehensive
General Plan because the number of dwelling units are within the General Plan
designation for that area.
A~D, FURTHER, that this variance is granted subject to the following conditions:
1. That the garage be extended to the required 20 ft. length.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance request by the following vote:
AYES: Comms. Collins, Cummings, Sims, Chmn. Beard
NOES: Comm. Ebey
ABSENT: Comm. Toth CERTIFICATION
