HomeMy WebLinkAboutBZA 154-204RESOLUTION B.Z.A. 154-204 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE TO ADD TO A SINGLE FAMILY DWELLING LOCATED ON A C-1 LOT ON PROPERTY LOCATED AT 99 HERMOSA AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 2, 1976, in the Council Chambers of the City Hall, consid- ered the request of Mr. and Mrs. Roy M. Knox for permission to be allowed structural alterations (a new study and new deck located above the existing structure), to an existing nonconforming building; i.e., a single family dwelling located in a C-1 zone, on property known as NW 46 ft. of Lot 21, Block 1, Hermosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the reuqest is necessary in order that the applicant would be allowed to make any structural alterations to the existing building due to the nonconforming status; that the property is currently zoned C-1 but there is a proposal to change it to R-3, however, this change would probably make it more nonconforming; that the northerly yard adjoins City property (walk street); that there are substandard yards on several sides; and WHEREAS, at said public hearing, the applicant stated that the proposed addition would improve the appearance of the building relative to the area around him; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request, and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because due to zoning code changes after the construction of the residence, a strict interpretation of the code would create an undue hardship on the applicant. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vic- inity and zone, and denied to the property in question because there are other properties in the same vicinity and zone which were developed under a previous code, which has been changed. 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicin- ity and zone in which the property is located because the variance merely upgrades the property in question to a level with the surrounding properties. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because the extension of residential usage in this C-1 zone is not detrimental to the General Plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance request by the following vote: Ayes: Comms. Collins, Cummings, Ebey, Sims, Chmn. Beard Noes: None Absent: Comm.
