HomeMy WebLinkAboutBZA 154-206RESOLUTION B.Z.A. 154-206 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE TO MAINTAIN AN OVERHEIGHT FENCE ON PROPERTY LOCATED AT 725 CYPRESS AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 16, 1976, in the Council Chambers of the City Hall, consid- ered the request of Mr. Robert R. Bogdanovich to maintain an existing fence which exceeds the six foot allowable height limit, on property known as Lots 1,2,3, and 4, Block 11V11 , Tract 2002; and WHEREAS, at said public hearing, the following facts were presented for consideration; that there was a permit for construction of the fence but only to a height of 6 ft.; that it is for security and provides visual contact with the area behind; that it is in an industrial rather than a residential area; and WHEREAS, at said public hearing, the applicant stated that the former existing fence had been over 6 ft. high, and has been replaced by a wrought iron fence; that he has letters from the Police and Fire Departments indicating their approval of the fence; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justiffed for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because of the necessity for security. 2. That the variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because fence height is important for protection of the property. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vic- inity and zone in which the property is located because safety, fire and police considerations find this fence acceptable. 4. That the granting of the variance will not adversely affect the comprehen- sive General Plan because there is no application to density and hence no effect on the General Plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant tl'E request by the following vote: AYES: ColT!lls. Ebey, Schutz, Toth, Chmn. Cummings NOES: None ABSENT: Corrms. Beard, Collins, Sims CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-206 was adopted by the Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the 20th day of September, 1976.
