HomeMy WebLinkAboutBZA 154-208RESOLUTION B.Z.A. 154-208 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE FOR A SIX-FOOT FENCE AT PROPERTY LINE ON PROP- ERTY LOCATED AT 505 GOULD AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on September 20, 1976, in the Council Chambers of the City Hall, con- sidered the request of Mr. and Mrs. Richard B. Ganong for a variance to construct a fence (wall) to a maximum height of 6 ft. at property line (front lot line and east lot line at street side), on property known as Lot 3 and NE 10 1 of Lot 1, Block 136, Shakespeare Tract; and WHEREAS, at said public hearing, the following facts were presented for considera- tion; that the proposed construction shall not interfere with the public safety and welfare and should reduce the unnecessary hardship of the constant traffic flow in the immediate vicinity; and WHEREAS, at said public hearing, the applicants stated that their house is located on a busy intersection; that at present 10 stop signs exist and the noise level is extremely high; that the fence is necessary for both safety and privacy; that they would like to landscaoe their yard for outdoor living purposes; that the wall will be of cement block construction with stucco over and used bricks at the corners; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjust- ments, that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because of the excessive traffic noise in the area. 2. That the variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because it adjoins a major arterial approach to the city. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the fence will not be impeding visibility. 4. That the granting of the variance will not adversely affect the compre- hensive General Plan because it does not affect zoning or density. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Corrons. Beard, Collins, Cummings, Ebey, Schutz, Toth, Chmn.
