A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE TO MINIMUM DRIVEWAY WIDTH, GARAGE LOCATION
AND TURNING RADIUS ON PROPERTY LOCATED AT 535 PROSPECT AVENUE, HERMOSA
BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at public
hearings held on September 20 and October 4, 1976, in the Council Chambers of the
City Hall, considered the request of Mr. and Mrs. Warren B. Grant for a variance
to maintain an existing driveway less than the required 9 ft. in width; and provid-
ing a turning radius less than the required 25 ft.; and to locate the garage along
the westerly and northerly property lines, on property known as Lot 44 (exc. the
westerly 40') Tract 5209; and
WHEREAS, at said public hearings, the following facts were presented for considera-
tion; that there are no existing utility easements to the rear of the property; and
WHEREAS, at said public hearings, the applicant stated that the existing 8 ft.
driveway can be negotiated by a full size automobile; that the new garage will pro-
vide additional offstreet parking; and
WHEREAS, at said public hearings, the neighbor located to the rear of the property
objected to the garage being located on the rear property line adjacent to his
building due to reduction of light and air for his lower unit; and
WHEREAS, at said public hearings, a petition was submitted with four signatures of
residents in support of the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified, subject to conditions, for the following
reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the existing property improve-
ments conformed to the then applicable building code and conformance to
the current code for driveway width would impose undue hardship on the
applicant. Also the owner of the property abutting the applicant's rear
property line agreed in public hearing to the approved setback configura-
tion for the proposed garage structure.
2. That the variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vic-
inity and zone, and denied to the property in question because neighbor-
ing properties have been permitted garage facility improvements and due
to existing improvements strict conformance would place undue hardship
on the applicant.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in: such
vicinity and zone in which the property is located because the existing
driveway, though substandard, is safely negotiable by private vehicles
and the property owner to the rear has agreed to the modified rear yard
setback.
4. That the granting of the variance will not adversely affect the compre-
hensive General Plan because this variance will not affect the number of
dwelling units nor the designated land use nor any other community char-
acteristics addressed by the General Plan.

AND, FURTHER, that the variance is granted subject to the following condition:
1. That the garage be located four (4') feet from the rear property
line.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the
Board of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: CoRJns. Beard, Cummings, Ebey, Chmn. Sims
NOES: None
ABSENT: Comns. Collins, Schutz, Toth
CERTIFICATION
I hereby certify that the foregoing Resolution B.Z.A. 154-209 was adopted by the
Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held
on the 18th day of October, 1976.
