HomeMy WebLinkAboutBZA 154-210RESOLUTION B.Z.A. 154-210 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE TO ADD MORE THAN 40% TO AN EXISTING DWELLING WITH NONCONFORMING YARD SETBACKS ON PROPERTY LOCATED AT 944 -13TH STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on October 4, 1976, in the Council Chambers of the City Hall, consid- ered the request of Mr. and Mrs. H. Allen Glenn for permission to add more than 40% to an existing single family dwelling with nonconforming yard setbacks, on property known as Lot 23, Tracy Tract; and WHEREAS, at said public hearing, the applicant stated that even with the three foot setback the house will remain at least fifteen feet from the neighboring dwellings; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjust- ments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or condi- tions applicable to the property involved because in the Board's judgment this property's setback nonconformities are exceptional in regard to the 40% rule. 2. That the variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because neighboring properties enjoy similar exemptions. 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because this property's nonconforming setbacks, though substandard, are not detri- mental to the public welfare or neighboring properties. 4. That the granting of the variance will not adversely affect the compre- hensive General Plan because this variance will not affect the number of dwelling units nor the designated land use nor any other community characteristics addressed by the General Plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. Beard, Cummings, Ebey, Chmn. Sims NOES: None ABSENT: Comms. Collins, Schutz, Toth CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-210 was adopted by the Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the 18th day of;;,obf .' 1976.
