WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on October 18, 1976, in the Council Chambers of the City Hall, consid- ered the request of Mr. and Mrs. Robert Bergstrom for permission to be allowed a second story addition over an existing garage structure with nonconforming yards, on property known as Portions of Lot 9 and Lot 18, Block 21, Hermosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the nonconforming condition exists because the original construction was not loc- ated in the center of the lot; that there appears to be no detrimental effect due to such construction; and WHEREAS, at said public hearing, the applicant stated that the lot is pie-shaped and the sideyard lacks 711 , but not all along the property line; that the existing house is 1100 sq. ft.; that the adjacent house is forward on the lot so the two are not close together; that the neighbors and the people on the walk street have signed their petition; and that they will sign a deed restriction that the property can be sold as a single family dwelling only; and WHEREAS, at said public hearing, a petition with ten signatures of neighboring resi- dents in favor of the request was submitted; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because of the irr~gular shape of the lot. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because other properties on the street share nonconforming setbacks. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because it will not be deterimental to the neighborhood. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because it retains conformity to the General Plan and has no density ramifications. NOW~ THEREFORE, BE IT RESOLVED that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. Schutz, Toth,Chmn.
