HomeMy WebLinkAboutBZA 154-214RESOLUTION B.Z.A. 154-214 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE FOR OVER 40% ADDITION TO RESIDENCE WITH NON- CONFORMING YARDS ON PROPERTY LOCATED AT 1907 VALLEY PARK AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hennosa Beach, at a public hearing held on October 4, 1976 and October 18, 1976, in the Council Chambers of the City Hall, considered the request of Mr. Brian Conroy to add more than 40% to an existing single family dwelling with nonconforming yards, on property known as Lot 23, Tract 15546; and WHEREAS, at said public hearing, the applicant stated that the wall in question is a garage wall, encroaching 1'211 , and none of the new construction will be on that side; that it would be an economic hardship to move the wall; and WHEREAS, at said public hearings, one resident spoke in opposition to the reqaest; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjust- ments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property because the request is consistent with the general purpose and intent of the code as the original construction met all sideyard requirements at the time of construction; and all new con- struction will meet current requirements. 2. That the variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because there are other existing nonconforming sideyards in the same vicinity and zone. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because it will only enhance the property in question and does not infringe on the rights of other property owners. 4. That the granting of such variance will not adversely affect the com- prehensive General Plan because it meets the zoning and density require- ments presently in existence. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Corrms.
