HomeMy WebLinkAboutBZA 154-217RESOLUTION B.Z.A. 154-217 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING AN AMENDMENT TO B.Z.A. 154-201 TO INCLUDE A WESTERLY SIDE- YARD ENCROACHMENT ON PROP.ERTY LOCATED AT 2025 CIRCLE DRIVE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on October 18, 1976, in the Council Chambers of the City Hall, consid- ered the request of Mr. Robert Edlefsen for permission to encroach a deck into the required westerly sideyard setback, on property known as Lot 13, Tract 3853; and WHEREAS, at said public hearing, the applicant said the encroachment would be 13 sq. ft. into the sideyard setback; that the alternative would require major structural modification of the house and the costs would be prohibitive; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjust- ments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the strict application of the ordinance in this case may create an undue hardship in that the original structure was developed to other standards. 2. That the variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because other properties in the area do have nonconforming sideyards. 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located it does not infringe upon any other adjoining properties. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because there is no increase in units. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comm. Schutz, Toth, Chmn. Beard NOES: Comm. Ebey ABSENT: Comms.
