HomeMy WebLinkAboutBZA 154-219RESOLUTION B.Z.A. 154-219 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE TO ADD TO A PROPERTY WITH NONCONFORMING YARDS ON PROPERTY LOCATED AT 32 -21ST STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on December 6, 1976, in the Council Chambers of the City Hall, recon- sidered the request of Mr. and Mrs. Robert Bergstrom for permission to be allowed a second story addition over an existing garage structure with nonconforming yards, on property known as Portions of Lot 9 and Lot 18, Block 21, Hermosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the request is being reheard on the advice of the City Attorney due to the pos- sible lack of a legal voting quorum at the October 18, 1976 meeting; that the noncon- forming condition exists because the original construction was not located in the center of the lot; that there appears to be no detrimental effect due to such con- struction; and WHEREAS, at said public hearing, no one appeared to speak in support of or in opposi- tion to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because of the irregular shape of the lot. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vic- inity and zone, and denied to the property in question because other properties on the street share nonconforming setbacks. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because it will not be detrimental to the neighborhood. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because it retains conformity to the General Plan and has no density ramifications. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Conms. Beard, Collins, Cummings, Toth, Chmn. Sims NOES: None ABSENT: Comm.
