C. 154-.4 A RESOLUTION OF RECORD OF THE PLA.mUNG COMMISSION OF THE CITY OF HERMOSA BEACH SETTING FORTH THE INTERPRETED I NTENT OF THE ZONING ORDINANCE RELATIVE TO THE PE..'{!>fITTED USE IN A c ... 1 ZONE OF C.t\F.ES (WINE AND BEER SALES ONLY) THE pI,ANNING COMMISSION OF THE CITY OF HERMOSA BEACH does resolve as follows: WHEREAS, at a regul.ar meeti~ of the ~lanning Cormnission of the City of Hermosa Beach, held at the Ci ~Y. Hall 1.n Re~osa Beach, California, on June 11 1962, under the provisions of Section 1101, No s. 154, the Commission conside;ed the clarification of the intent of the zoning ordinance relative to the permitted use in a c-1. zone of cafes (wine arld beer sales only); NOW THEREFORE, BE IT RESOLVED that the Planning Commission, in studying the matter and consulting its records in regard to its intention at the time of amending Zoning Ordinance N • S. 154 by Resolution P. C. 154-273, changing all commercially zoned property into three classifications: C-1 "Limited Business and Residen tia1tt; C-2 ''General Commercial Districtn; and C-3 ''General and Highway Commercial District, 1t ~finds its interpreted intent to be that the C-1 classification would be businesses which would be located close to and adjoining residential property. Therefore, the businesses should be types that are oper~ted primarily in daylight hours and close at a reasonable and normal hour in the evening, compatible with the residential nature of the area. The activity and noise of conducting these types of businesses woul.d be moderate and in keeping with the surr ounding residential nei ghborhood. It w~s the intent of this Planning Commission in allowing cafes i n a residential zone ·to sei·ve beer and wine in conjunction with the food service, the primary use being the serving of food, and the beer and wine sales incidental to the operation, and to cater primarily to the local residents and not to the general transient trade, as exampled by the cafes • th beer licenses that we;re in existence at the time the C-1 zone was :tablished. Restaurants woul.d be so designed and conducive to attract the fam.ily .... type patronage-~ all_ service to ~e either from a table or booth, with no bar service, no enterta1.nrne11t or noise factors to be conducted therein; and BE IT FURTHER RESOLVE~ that a copy of said resolution be forwarded to the • City council of ~he City of.Hermosa Beach, and if approved by said Council, thereafter such interpretation shall govern. The foregoing resolution was adopted by the Planning Commission at a regular meeting held on June 11, 1962, by the following vote: AYES: NOES: ABSENT: Comm.
