A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH GRANTING A ZONE VARIANCE UPON CERTAIN PROPER.TY LOCATED ON
THE STRAND IN THE CITY OF HEIDfOSA BEACH, CALIFORNIA
THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH does resolve as follows:
WHm.EAS, there. was filed with :this Connnission, under the provisions of
Ordina.tice N. S. 154, application for zone variance by Bernice Robinson upon
propert;yowned by the applicant and located at 52 Strand; and
WHEREAS, the ~lanning Commission of the City of Hermosa Beach did on
April lo, 1 961, conduct a public hearing to. consider this application t o
permit the addition of a single..:.family dwelling, the existing dwelling having
a nonconforming 3' southerl y sideyard and balcony to property line, and a
garage structure having three nonconforming garages and garage apartment,
on an R-3 lot 45x80', proposing that the new building be 4'·with a solid wall,
from the existing dwelling, 3 r from the north property line, six feet from
the rear structure and a roofed, open balcony to the front property line, on
that property described as follows:
Lot 13 and the North 1/2 of Lot 12, Block 1,
Hermosa Beach Tract;
NOW,, THEREFORE,, BE IT RESOLVED that, in view of the findings at said hearing,
the Planning Commission does hereby grant this zone variance for the construction
of an addition of over 30% to the existing building with a nonconf orming sideyard
and front yard and nonconforming garages, with the proviso that the northerly
sideyard of the new dwelling conform to the ordinance, that the distance between
the existing garage and the addition conform to the ordinance, that a roofed,
unenclosed balcony encroach to the property line in line with the existing balcony
in lieu of l' setback permitted for balcony projections, and with the further
proviso that there be J3ilei!twith the Building Department a statement that the
living quarters attached to the garage shall not be used for rental purposes,
for the reasons that said property is zoned R-,.3; that all of the surrounding
property is· used as R .... 2 or R-3; that the addition will tend to be the best use of
the property and upgrade it; that the existing small unit attached to the garage
does not lend itself to. rental purposes; that the short~g~ of square footage is
overcome to a great extent by the filing of the affidavit not to use the small
unit attached to the garages for rental purposes.
The foregoing resolution was adopted by the· Planning Commission at a regular
meeting held on the 10th day of April, 1961., by the following vote:
AYES: Comm. Black, Fredricks, Johns.on and Nob le.
NOES: Co:rmn. Hales and Chairman Viault. (Chairman Viault asked the record to
show that he opposed an unrestricted b alcony to front property line.)
ABSENT: Comm. Locken.
