Meeting called to order at 7: 36 P .M. by Cornn. Merrill Pledge of Allegiance led by Conm. Williams ROIL CAIL PRESENT: Conms . DeBellis , Ebey, Merrill, Williams , Cbrrn. Moore ABSENT: Corrms . Cutler, Toth AI.SO PRESENT: Laurie Duke, Staff Ll.aison Janice Silver (for purposes of cross-training) Coorns. Cutler and Toth were excused from the neeting. Chnn. Moore excused himself at 7 :40 P .M. CoIIIll. Merrill acted as Chainnan for the ~eting. Chrrn. Merrill appointed Cornn. DeBellis to act as Secretary for the ~eting. APPROVAL OF MINUTES Motion by Conm. Ebey, seconded by Cornn. Williams , to approve the May 3, 1982 , minutes as submitted. No objections. So ordered. APPROVAL OF RESOLUITONS None CONSENT CALENDAR None PUBLIC HEARINGS CUP REQUEST BZA 154-459 -1818 Monterey Boulevard Applicants : Mr. & Mrs. Dann LeMasurier Mrs. Duke gave staff report. She stated that the property was located in the R-2 zone, rredium density residential. The applicants were requesting permission to operate a traffic school on Saturdays in a classroom at St. Cross Episcopal Church. The church is located on the east side of Monterey Boulevard between 16th and 19th Streets. She stated that the .I school will have a California State Departrrent of Motor Vehicles

The anticipated class size is 35 students and the State-imposed rmx:inum class size is 40. There is IIDre than adequate off-street parking provided, as the entire parking lot beh:ind and beside the church is available for this use on Saturdays. She noted that the proposed hours of operation are 8 :00 a.m. to 4: 3J p .m. , Saturdays only. The Staff Review Comnittee found no adverse impacts connected with this use. Ebe stated that staff recon:mmded five conditions be applied to the conditional use pennit, if approved. Cornn. DeBellis asked if it were a profit-rmking organization. Mrs. Duke replied ill the affirrrative. Corrm. Ebey asked if the applicant had explored the possibility of using the Connrunity Center. Mrs. Duke replied that the applicant did try to locate in the Savings and loan Association at Alpha Beta shopping center. 'lhey v.ere willing to lease their conference room on Saturdays; however, the owner w::iuld not sign the conditional use permit application because he felt it would impact their parking on Saturdays. Conm. Will iruns asked for the nunber of parking spaces at the church in question. Mrs. Duke replied that there are over 100 parking spaces. Conm. DeBellis asked if the Board had the power to deny the conditional use permit. Mrs. Duke replied that the Board has the right to deny the conditional use permit if it feels that it would be a severe inpact. Public hearing opened at 7:53 p.m. Dann LeMasurier, 240 South Sepulveda, Manhattan Beach, applicant , stated that he -was opening the school because the closest school of this type was located in Santa M:,nica. He noted that the school is accredited by the State; thereby eliminating any record of traffic tickets. He stated that the class will be taught by a police officer of the commnity. Conm. DeBellis asked the applicant if he had explored other sites. :Mr. LeMasurier replied in the affi.rnative, add:ing that the owner of the shopping center did not want him to use the conference room at the Savings and Loan. Corrm. Ebey asked the applicant if he had checked with the Comrunity Center.

Mr. LeMasurier replied in the affirmative; however, they charged $35.00 per hour for the use of their facilities. Mr. LeMasurier noted that he had been a nember of the St. Cross Episcopal Church for 22 years, and he believed that the donations should be going to that church. He added that when other activities are scheduled for Saturday, traffic school will not be held. Cornn. DeBellis asked for the fee required to attend the class. Mr. I.eMasurier replied that it would be between $10. 00 and $15. 00 per person. He noted that the class would be eight hours. Corrm. DeBellis asked for figures regarding donations to the church. Mr. Le.Masurier replied that he and the Church agreed that he would donate$ .50 per person. Carm. De.Bellis asked if the students would leave the grounds for lunch. Mr. LeMa.surier replied that they have the option to leave for lunch. He added that the lunch break is half an hour, and if a student is tardy, he will be dismissed without being accredited for traffic school that day. Corrm. Williams believed there were free traffic schools. Mrs. Duke stated that the doCUITE11.t at the Court which lists accredited traffic schools indicates that there is a fee to attend traffic school. She believed that the closest traffic school at this time was located in Lawndale. No one appeared to speak in favor of the conditional use pennit. Dr. Laurel Roberts, 1656 Bayview Drive, Hermosa Beach, stated that she had submitted a letter to the Board opposing the proposed conditional use pennit. She stated that the school does not qualify as an educational institution, and there is not sufficient parking at St. Cross Church. Chnn. Merrill declared that several letters were submitted to the Board from persons opposing the conditional use pennit, those letters being from Dr. and Mm. Paul Daily, 1633 Bayview Drive~· He:rm:>sa Beach; Dr. Laurel Roberts, 1656 Bayview Drive, Herrrbsa Beach; Angus and Lorraine Roberts, 1656 Bayview Drive, Henrosa Beach; Mrs. W. DeBellis noted that the applicant would make a profit of $437. 00 every Saturday that the school was in operation. He believed that there may be problems with traffic. Comn. Ebey stated that there had never been so many objections from the public for a conditional use permit. Comn. Ebey asked if the Board could deny the request. Mrs. Duke replied that the ordinance does not say that the Board could not deny it, and she read that ordinance to the Board. She stated that the ordinance does not say that the Board must grant the conditicnal use permit. Conm. WillimIB questioned whether there were 100 parking spaces available every Saturday. Mrs. Duke IIEI1.tioned that the school is not intending to IlEet each and every Saturday. She stated that they will neet on an as-needed basis. Motion by Corrm. Ebey to deny CUP Request BZA 154-459. (Motion died, due to lack of a second.) Cornn. Williams noted concern for increased traffic and parking. Conm. DeBellis proposed allowing the traffic school to 1IEet only one Saturday per non.th. He also proposed a three-IIDnth review period because of the heavy opposition from the public. Mr. LeMasurier stated that the persons attending the traffic school would park off-street. Chrm. Merrill infonred the applicant that El Camino College has a commnity service program which is quite extensive. M::>tion by Conm. Ebey, seconded by Corrm. DeBellis, to deny Conditional Use Permit Request BZA 154-459 at 1818 Monterey Boulevard. AYES: NOES: ABSENT: Corrrns. DeBellis, Ebey, Williams, Crum. Merrill None Conms . Cutler , Toth, Chnn. Moore Comn. DeBellis stated that one reason for denial was that it was a potential traffic hazard. Conrn. Williams concurred, adding that Saturdays are one of the worst days for traffic. Conm. Ebey noted that there were ID:IIlY other sites available in Henmsa Beach that would be rrore feasible.

Ebey, to allow the applicant to reapply for another site without having to pay an additional $365.00. No objections. So ordered. CUP REVIEW P.C. 154-1086 & 154-1115 -16 Fourteenth Street Applicant : Mr. Harold Cohen Mrs . Duke gave staff report. She stated that the property was located at 16 Fourteenth Street, and the business was the La Playita. The reason for the conditional use pemri..t was for the service of beer and wine in conjunction with the operation of a restaurant. She stated that the applicant has leased the property to the east of his existing restaurant in order to ezpand the size of his operation. She noted that the Planning Conmission granted the original beer and wine use permit. The applicant then asked for roodification of their hours of operation. The Police Departrrent had indicated that there had been no problem, with this business. She stated that there had been two calls in response to the hearing notice mailed ten days ago, one from Mr. Freese (the residential neighbor to the east) and one from Mr. Dave Johnson (Editor of the Hermosa Review). Both gentlerren had favorable COIITIEilts on this business. She stated that, if the Board desired, a new resolution could be prepared corrbining all of the conditions of the earlier resolutions, plus any additions the Board and the applicant agree on. Chnn. :Merrill noted that the Board had granted a conditional use pennit on the property at 1340 Strand for a take-out window. He stated that the take-out window is eristing and is in operation. Public Hearing opened at 8:37 p.m. Harold Cohen, 957 2nd Street, Herrrosa Beach, applicant, stated that he is requesting the conditional use permit because he needed nnre space for his business. He added that he will continue to use the take-out window. Conrn. Williams asked why there were no screens on the windows. Mr. Cohen replied that he was inforned that screens were not necessary as long as there were no complaints. Mrs. Duke stated that his current hours for the sale of alcohol are from 9 :00 a.m. to 10: 00 p.m. Mr. Cohen requested that his hours of operation be from 8 :00 a.m. to 10:00 p.m. Corrm. Willimrn requested that the Board obtain a staterent of policy regarding screens from the City Council.

Merrill requested staff to obtain a report from the City Council regarding the enforceability of screens. Corrm. DeBellis stated that he would make the addition of screens a condition of approval. Chnn. Merrill stated that the original Condition No. 3 should read, "All alcoholic beverages shall be consurred within the premise, and none may be taken out or served through the take-out window." No one else appeared to speak in opposition to the conditional use penait. Public Hearing closed at 8:56 p.m. Motion by Conm. DeBellis, seconded by Cornn. Ebey, to approved CUP Review P.C. 154-1086 & 154-1115 subject to the original conditions with the following arrendrrEnts: that the hours of operation be 8:00 a.m. to 10:00 p.m., that Condition No. 7 be deleted, and that Condition No. 3 be aIIEnded to read, '', . . and none may be taken out or served through the take-out window."
